  6. hi thanks for your answers on both side of the argument....but what about the human rights act 1998 about the freedom of expression..does this not count.. 12 Freedom of expression (1) This section applies if a court is considering whether to grant any relief which, if granted, might affect the exercise of the Convention right to freedom of expression. (2) If the person against whom the application for relief is made (“the respondent”) is neither present nor represented, no such relief is to be granted unless the court is satisfied— (a) that the applicant has taken all practicable steps to notify the respondent; or (b) that there are compelling reasons why the respondent should not be notified. (3) No such relief is to be granted so as to restrain publication before trial unless the court is satisfied that the applicant is likely to establish that publication should not be allowed. (4) The court must have particular regard to the importance of the Convention right to freedom of expression and, where the proceedings relate to material which the respondent claims, or which appears to the court, to be journalistic, literary or artistic material (or to conduct connected with such material), to— (a) the extent to which— (i) the material has, or is about to, become available to the public; or (ii) it is, or would be, in the public interest for the material to be published; (b) any relevant privacy code.   7. hi,i work for royal mail and we have as you all are aware been on strike and just returned to work...is there something somewhere which says we have to talk to other colleagues ( strike breakers )...i do not want to have to talk to them for obvious reasons but we have been told this is not allowed...can someone please clarify the situation...surely i also have rights to free speech..thanks paul

  10. right fed up with photo..the letter says... We have tried to obtain the copies of original documents on your behalf but unfortuantely we have been informed by the selling bank that these cannot be retreived from archives... The credit services assoc.,of which this company is a member,advises in its guidelines that the debt sale process can be complex.However it states that members of the Association are to deal with requests under section 77 ( 1 ) as though they were the originating creditor,in so far as they are able to.The CSA states that it is up to each member on an individual gasis to decide how far to comply with the act.It is the decision of this group to seek to adhere to the provisions of the Consume Credit Act as much as possible,but we have not inherited the liabilities of the original creditor ( citi financial ),for instance having to provide a copy of the original agreement... We did not provide you with the original credit facility,We purchased your outsatnding debt balance and the right to collect the that balance.We did not purchase the documents;consequently there is not an obligation to provide you with any copies.When accounts are legally assigned,we do not purchase the liabilities of the original creditors. However,as a matter of good practice,we have tried to obtain copies from the original credit grantor.As we have previuosly stated,these are not available. Entirely without prejudice,we would be prepared to accept 50% of total as full and final settlement of the account...blah blah you have 3 weeks to respond.. this is what is written in the document..sorry about the photo..and thanks again..paul

  12. hi recieved a letter today after about 6 months requesting a copy from aktiv for my credit agreement..they bought it from capital one and now they are saying they cannot supply it...there is a 50% offer to pay if i pay within 3 weeks i will try to attach a copy here if not can sent via email....any advise or emtplates please..thanks paul
  13. hi recd a letter today for a £120.00 ticket for stopping to look at my a-z on double red lines..1 min max..recd a letter today saying i was spotted via camera...i am sure there is no signage saying cameras about..how do i stand and any advise will be great..thanks paul..
  14. hi,sent a data protection letter to the above requesting all information regarding a loan a took out with them.....i requested all details regarding charges and i want them refunded....because they have now sold this to aktiva a debt collection agency the above have said they no longer have any details regarding the acct.. i have also requested the original copy of the credit agreement but they said to get hold of aktiva and they will send them...here we go....i contacted aktiva and they have said i must go to citifinancial...any one with any help ie.the credit agreement ( how do i get a cpy and do i have to pay if they cnnot provide it )..and where do i stand in paying the debt off and to claim the charges back..thanks all and keep up the good work..

  16. hi was successful in getting my charges back from the woolwich 3 months ago but they have built up again...wrote to the woolwich saying that i am going to go for it a 2nd time ..they said after careful consideration they will not refund me and if i do not like it go elsewhere...any help please....thanks liz
  17. hi all,recd a parking ticket today whilst in a council car park..overstayed by 6 minutes yuk ( £100.00 fine joke )....i am pretty sure that this is not valid ( enclosing a scan for you experts to look over )..some quick questions... there is no appeal section anywhere on the ticket..is that allowed... do i pay the fine before appealing or appeal without paying.. also are there any templates for correct wording for sending an appeal letter..thanks paul i am unable to add an attachment any ideas anyone..if you want to see the ticket i can email it to you if you agree to of course....paul
  18. hi,just keep to your timetable and not theirs....you will get all your money refunded as i did from the woolwich of over £1,000...they will go right to the wire as per the courts but will settle before it gets there...so do not worry and good luck...paul

  21. what a bunch of b*****ds a & l are...my advice to you is write to a & l saying that you are not happy about the acct closure and say that you will be sending the letter you recd from them to the office of fair trading as you believe this to be a retalitary action by them regarding unlawful charges...then see what happens...good luck paul
