  1. No Lender or mortgage provider is going to take a near 6 year old default into account, in their decision making. Providing you don't have any newer one's of course. You will be very surprised that in a few months when they have all fallen off your Credit Score won't budge. If you want to improve you're credit Score, the best thing you can do is take out a credit card with a low limit, use it regularly and pay it back every month, so it doesn't accrue any interest. Watch your score tick upwards over the next 12 months. Source.. That happened to me
  2. Your credit rating is nothing to do with these defaults.
  3. If they were defaulted in 2017' they will drop off your Credit File at some point this year. It's worth noting that those defaults are so old they will likely have no effect on your eligibility for credit or a mortgage, even before they have dropped off.
  4. And it's not out of the question that he will just cough up the money on site of a claim form anyway.
  5. Lowell have brought a ton of ancient debts, probably for a few pence in the pound, the idea being to find people who are no longer at the same address and to obtain an undefended back door CCJ. However, if you send the Statute Barred letter with your current address on it, there is zero chance they can do anything. All that peace of mind for the price of 2 first class stamps! You get the best advice here!
  6. Just ignore anything they send unless it's a letter before action, and for the love of all things holy don't pay them anything, the statute barred clock had been ticking along nicely for nearly 4 years now, it's only got another 2 to run. Any payment you make will reset that for another 6 years.
  7. I can almost 100% assure you that after 6 years, nobody will be trying to enforce anything on a £1327 CCJ. Technically you still owe the money , that's for sure, but , it will cost them more to take it to court and collect than they would receive from you. Plus no lender , or anybody else will ever see it again as it dropped off your credit file last year at some point.
  8. I've been dealing with my wife's PP debt, seriously don't lose any sleep over it, just make sure they have your correct address, and 99% nothing will ever happen. If it does just come back here.
  9. Not worth worrying about, I've had bigger debts with all of the above, The only one I can't speak for are Barclaycard . Nobody else did anything outside of angry letters.
  10. None of the banks will do anything if they own the original debt. Between my wife and I we had around 10 Nat West and HSBC loans. credit cards and Overdrafts, they all went statute barred more than 7 years ago, no action taken. As for doorstep representatives, I had one come round once, strangely it was January this year about a debt that had gone statute barred in 2020. I told her this and she looked very embarrassed , said she wouldn't bother us again.
  11. As above, never talk by phone, don't bother with any debt management companies. You probably missed the court letter sent after the CCJ was issued, asking as for the sum of £50 per month to be paid, that's what I did, for me it was an affordable sum that paid off a similar size CCJ to yours in a few years. If you can afford that I would just write back to them proposing £50ppm, which is what the judge ordered anyway alternatively just fill in the I and E sheet explaining how much you can afford. As time moves on the CCJ will become less and less of a burden on your credit file, after a few years it will have minimal impact, so none of this is really world ending. It's just a good lesson to keep all creditors informed of your current address.
  12. Brent council have zero interest in putting you into poverty and allowing you to lose your home, I hope you realise that, despite the fact that the council contact centre, finance department and Bailiffs will tell you otherwise. That is the reason why you need to speak to / communicate with the right people, who in your situation is your local elected councillor. Fortunately their details are on Google, email and mobile number. Give them an email and a call, explain your situation and what you can afford to pay per month, and all of this could be resolved by tea time.
  13. Yup, I would say for the price of a first class stamp, you've likely stopped this dead in it's tracks.
  14. My money is on this being stopped dead in it's tracks! All for the price of a first class stamp.
  15. Excellent ! They have acknowledged they have received it ,
  16. The most important question here, is Have you moved since taking out the loan? I say this because Lowell love an easy target, and if you haven't kept them updated with your latest address in writing, you are one big bulls eye. Do not be fooled by receiving letters to your current address, you can guarantee that the actual Claimform will go to an old address, and next thing you know there is a CCJ in your name. Lowell's business model is to buy the cheapest, most unenforceable debts, for a few pence in the pound, secure in the knowledge that many of them will be an easy win, to an old address AKA Backdoor CCJ. The very good news is that for the price of a first class stamp writing to Lowell, you can insulate yourself with a simple statement ' I insert name, currently live at insert address. Then to double insulate yourself, send Lowell a CCA request, they never come up with the goods. Do not pay them anything or contact them in any way, unless you receive a claimform (highly unlikely if you do the above), then you post on here for advice. I have had 2 CCJ's from Lowell, learnt the hard way, went to an old address, but once I'd taken the advice here that never happened again.
  17. When did the debt default? When did you make the last payment on it?, Have you moved address since taking the debt out? How much is it for and who is the original creditor?
  18. Cripes 4 bedrooms !, my first thought was lodgers, round here decent rooms are gone immediately, Getting other driving jobs, delivery driver? anything? get the money coming in so judge can see that you are trying to right things.
  19. Unless of course you have a car parked outside or close by, they can clamp or take away. That's why contacting your local council representative is always the quickest way to A: Get the bailiffs off the case B: Come to an easy payment arrangement direct with the council C; Remove Bailiff Fees Often local councillors hate using bailiffs, they also have power over the council Revenue department, and can cancel or change a lot of things.
  20. whoaahh. hold on there... Run that past your local councillor via email and mobile phone, This will take you 2 minutes and likely settle the matter, and take B & S off your back. You will be able to find their details on Google. An email along these lines ... Dear xyz Unfortunately I have accrued a council tax arrears of X amount. I only have a disposal income of £x per month, and cannot pay the full amount as B And S have requested, and certainly can't afford the £375 extra they have demanded. However, I realise the importance of paying my council tax and am able to afford to give the council x amount per month , paid directly. I would also be great if you could remove the bailiff charge, Kind Regard xyz
  21. A debtor's instinct to run and hide, is a strong one, but it's the wrong one. That's how the likes of Moriarty et al make so much money from gaining uncontested backdoor CCJ's to previous addresses. Don't be fooled by the fact they are writing to you where you currently live, these are just speculative phishing letters, any actual Claimform will go to an old address. However once you write to them just stating where you currently live, the chances of any action go down to virtually zero. That's because they can no longer legally send an easy to gain uncontested CCJ to your old address. Also they will now know that there is every chance you would actually defend and win against their flimsy case, and that will cost them time and money, The 99% of other people hiding from their debt's are an easy win for them. Please don't do anything silly like offer them any money, that will only make it worse. This whole thing can be stopped in it's tracks for the price of a first class stamp.
  22. Lowell seem to have brought up a bunch of ancient Statute Barred debts recently. They do this because, their MO is to find people who have moved address , and gain a backdoor CCJ by default. Their business model is very sound, buy a debt for pennies in the pound, send a few phishing letters and emails, if no response then a Claimform straight to the old address. Next thing the poor victim can't get a mortgage, because a CCJ has seemingly come from nowhere, and your credit is stuffed for the next 6 years. Sadly I speak from bitter experience here, but now know that protecting yourself can be done for the price of a first class stamp. Just send the Statute Barred letter. Personally, I would also include another separate sheet with your current address.
  23. Simple, You send the CCA off, if they haven't responded to it within 12 plus 2 days, you don't need to do anything. Oh and for goodness sake don't pay any powerless DCA any settlement at all. You would be better off Sticking your money on red at the casino, or giving it to charity, or anything really but paying A DCA. Oh and paying a 'settlement' will not do anything to remove the debt from your credit file. The debt will drop of your credit file , all by itself on the 6th anniversary of the default, becoming totally invisible to lenders, or anybody else.
  24. Every single time I have sent a CCA request, (that's a lot of times), I've had a letter back saying ' Your account is now on hold while we look for the correct documents' The amount of time it's taken has varied from 6 months to never. Not once have I been sent a claimform for any debt that I have requested a CCA for. The last debt I had with Cabot, I CCA'd them in 2017, and got something back off them 6 months later. Strangely I never heard from them again, and it went Statute Barred a couple of years ago.
  25. Yup to above and the health issues, my wife has had stuff wiped off because of that with Lowells. Plus , Lowells tend to back off when challenged, eg CCA etc, or simply you confirming current address. That's because they make a huge amount of money from backdoor CCJ's., easy pickings for them. I think there was one example on here a few years ago on here where a foreign bank sent out hundreds of 'Letter before Claim' letters, not one person who actually replied, actually went on to receive a claim form. They were only phishing for the one's who didn't reply. That's where the easy money is.
