For What it's worth, the only people who have the right to ask for an income / expenditure report are HMRC, Tax Credits, DWP, Council Tax, Customs & Excise, or a Judge / Magistrate. Capquest and any other DCA are just con people into it by pretending they have the right. -

They make a an educated guess by looking at the electoral role, last known address etc, in other words phishing letters. However if you don't actively confirm your latest address, in writing, you have zero redress if you end up with an default judgement, that you never saw because it went to your old address. Lowell in particular, actively search these out. -

That won't be having any effect on your credit file, that default vanished from view a decade ago. Who cares if they broke GDPR, it's irrelevant just stop paying them. Anyway zero chance of them complying with a CCA. Stop paying them and ignore all Mail, calls, Emails , texts etc. Unless it's a claim form of course. -

But for goodness sake write to them with your current address. Lowell's MO is to seek out people who haven't correctly kept their contact details updated, and to send claim forms to their old address. This has happened to me twice. -

The CCA will give them 12 plus 2 days to find the relevant documentation, it won't happen, they will put the account on hold and you can stop paying, it won't be enforceable. Don't worry about whether they will comply with the CCA or not, until it happens. The fact that they are writing to you at your current address means nothing, they would be perfectly within their rights to send a Claim Form to your old address they have on file, and one day you'd have a CCJ out of the blue. That is the only way it would go to court. Along with the CCA send another letter, simply informing them of your current address -

You shouldn't have started to pay them in the first place, that's how they string out the statute barred thread to infinity. 1. Send a CCA , you can find the template on this site, after 12 days, when they haven't replied, then cancel your payments. 2. Ignore all begging letters until they have complied with the CCA request. 3. At some point if they actually manage to comply with the CCA. Send them a letter stating you are ill, listing everything, medications and a note from your GP / consultant. They will drop it like a hot cake anyway. Question for you? have you moved home since taking out the original debt? Remember, All communication to be in Writing by Royal Mail. NEVER answer an Email from them, NEVER answer a call or text from them. -

PP been chasing my wife for a debt, sold to Lowell. I sent a CCA Jan 6th, received account on hold letter Jan 20th. Since then , nothing at all. Looks like they simply don't have it. -

Calling the Bailiffs, or the Council call centre is a waste of time Do you have any of the following? On Benefits? Unable to Work? Chronic Ilness? Pregnant?, low income?. let me know and I can help with what to say, and finally get you into some affordable payments.

Boy oh boy, when I came back from Canada I had some CCJ's, none of them were fraud, all of them for long forgotten debts. the actual debts had disappeared off the credit file, so it looked like they were there in isolation. As for the credit check having found you, wrong again. It actually suits your creditors to have the wrong address eg you're last known address. That means they issue a judgement and win by default because you don't know about it. Like I did you have just learnt the hard way that you need to always update your creditors when you move. Quick question, do you own a property?

Yup this has happened to me, several times. Likely you have a CCJ, just sign up for Credit Karma, and you can find out what CCJ's are showing in the 'public' section'. It will take 5 minutes. Likely you will be able to pay off in affordable installments after submitting income and expenses. Check what other defaults and CCJs you have and contact all debtors with your current address details in writing. -
A good friend of mine keeps having this happen to him, thinks it's smart to keep the car registered at his cousin's address. The problem is it always comes back to bite him, he's terrible at driving in bus lanes for some reason . Two possible consequences for your step dad, from the bailiffs. 1. They tow his car and charge a fortune to get it back plus the fine 2. If the car is on finance they won't tow it but they will clamp it and charge an extortionate fee to release plus the fine Three good steps to take to resolve the problem. 1. Ring the Council, he may be able to appeal and if he wins just pay the original fine, or pay in instalments 2. Park the car far away from his current property 3. Update the DVLA details V5

They can say the Earth is flat if they want to but it doesn’t change the fact that they haven’t complied with a CCA request, which means the account is unenforceable.

Don’t bother, it’s all a waste of time , everything you are doing. They haven’t come up with a CCA the next move is there’s . Also if you ever do need to communicate with them again do not use email, it’s just another route for them to harass you. Plus there are loads of scam emails saying they are from Capquest .

Yup Andy, Capquest have just started sending me desperate begging letters for an account that went statute barred in 2010.
