  1. Yup this has happened to me, several times. Likely you have a CCJ, just sign up for Credit Karma, and you can find out what CCJ's are showing in the 'public' section'. It will take 5 minutes. Likely you will be able to pay off in affordable installments after submitting income and expenses. Check what other defaults and CCJs you have and contact all debtors with your current address details in writing.
  2. A good friend of mine keeps having this happen to him, thinks it's smart to keep the car registered at his cousin's address. The problem is it always comes back to bite him, he's terrible at driving in bus lanes for some reason . Two possible consequences for your step dad, from the bailiffs. 1. They tow his car and charge a fortune to get it back plus the fine 2. If the car is on finance they won't tow it but they will clamp it and charge an extortionate fee to release plus the fine Three good steps to take to resolve the problem. 1. Ring the Council, he may be able to appeal and if he wins just pay the original fine, or pay in instalments 2. Park the car far away from his current property 3. Update the DVLA details V5
  3. Probably,99% of the time that firm issues a CCJ, it remains undefended and Express win by default, which is precisely why they do it. In fact i'd not be surprised if it's part of their intended business plan.
  4. They can say the Earth is flat if they want to but it doesn’t change the fact that they haven’t complied with a CCA request, which means the account is unenforceable.
  5. Don’t bother, it’s all a waste of time , everything you are doing. They haven’t come up with a CCA the next move is there’s . Also if you ever do need to communicate with them again do not use email, it’s just another route for them to harass you. Plus there are loads of scam emails saying they are from Capquest .
  6. Yup Andy, Capquest have just started sending me desperate begging letters for an account that went statute barred in 2010.
  7. No need to refer to anything or bother writing back.
  8. Doesn't mean anything, I had at least 2 of those for childcare over a period of several years. Probably random!
  9. They are so useless. For years , in our old house TV licencing were convinced we were 2 separate houses. Despite having paid our TV licence, we constantly received threats under the previous name of the property to pay up, face fines, prosecution etc etc. I rang and wrote to them to explain, but still the silly threats rolled in, nobody ever came to visit. I was actually quite looking forward to actually explaining in person what idiots they actually were.
  10. Calling their bluff? You are just an entry on a spreadsheet to them. As for writing to them, it's not worth getting into pointless letter tennis. Just cease paying.
  11. All of the above!! As an aside a CCJ issued 12 months ago shouldn't be a barrier to getting a mortgage, find a good broker. You might pay a slightly higher interest rate, but could probably remortgage in a couple of years, even if you can't set aside the CCJ.
  12. Also know that morally what they are doing is despicable . You are totally morally in the right here .
  13. Banks don’t do court. I had Nat West overdraft , loans etc all defaulted and statute barred ages ago. Didn’t even get many letters after the first couple of years. Now they are offering me loans and overdrafts again , like it all never happened.
  14. Pers i'd go for writing the thing off completely. Just emphasise age, illness, loss of overtime etc more
  15. Stop paying. Start the SB clock ticking finally. Nat West won't take you to court anyway.
  16. Ignore them , let those idiots sing for it. Highly unlikely they will ever be getting any from you again. If you should happen to accidentally pick up, no need to be rude ‘ sorry I don’t give out personal details on the phone, goodbye’
  17. Yup there you go it's all been transferred over to the DWP, mine pre dated that. Give them a call, tomorrow first thing and explain circumstances.
