  2. I've recently been quite successful in having some payday loan defaults removed. in 2013-2014 I was a bit silly. I already had a Vanquis card with about £1500 on it, and ended up taking out a wonga loan, Payday Express, and finally a Sunny payday loan. Long story short, Wonga loan was wiped when they got busted by the FCA back in 2014. I wrote to Sunny saying I dont think they should have lended to me as my financial situation was already bad. They replied telling me they agreed and would remove the outstanding debt and Default on my credit file (which they have). I sent the same letter to Payday Express, who didn't agree. So I passed it onto the financial ombudsman. They agreed with me and have asked Payday express to remove the default and wipe the debt. My credit report is now looking a lot healthier! But I still have a default for about £1600 for a credit card with Vanquis/Lowell. The time of the default occurred when I was in the middle of juggling three payday loans. If the payday loan companies and the financial ombudsman agree that the loans shouldn't have been given to me, and caused me to default on an existing credit card. Then by rights the credit card default shouldn't have happened either. I'm not trying prove the credit card shouldn't be repaid here, but that the default was caused by three payday loans, that everyone agrees shouldn't have been given. And therefore the default should be removed. Can anyone advise the best way to go about getting the wheels rolling on this? I guess I should write to the ombudsman again? Or if you think I have no case.
  3. Payment was to parcelhero. The parcel weighed less than 10kg, but because of the size the 'volumetric weight' was 22.5kg. I entered both into the website and they quoted me on the largest i.e volumetric weight of 22.5kg. UPS audited the parcel and determined the volumetric weight was different to what I paid for. (it was apparently bigger than what I told them)
  4. I recently posted an Item with parcelhero. Went thought the normal process, entered weights into the website etc. Collected and delivered by UPS. A week later I received an email- A massive difference. I emailed to say I'm appealing, and they replied asking for evidence of the parcel size. I don't have any now its shipped and delivered (a week before contacting me). The part Is a little worrying, but I paid through papal so they have just issued an invoice. What can I do? If I dont pay, can they issue a default or pass this on to a DCA?
  5. OK, thanks. That makes sense. The OC is Vanquis, DCA is Lowell. Could you just clarify this part of your reply ... So you're saying a copy of the letter isn't required. they just need to prove that they have a log of the Default notice being sent. this seems to contradict what you said previously? Sorry not trying to be pedantic, just want to know if if it is worth perusing or not. I was following this guide [link removed - the old 3 letter trick!!- dx]
  6. I'm not entirely sure who created the initial default notice. From what I understand, when the debt is sold on the DCA changes the default into their name (it is in the DCA's name now). in any case, they have told me they don't have a copy. Should I continue to threaten to complain to the OFT/ICO,or just refer it to them now ?
  7. I currently have a default against my name, which I do not ever remember receiving a default notice for. I have written to the DCA that filed the default requesting a copy of the default notice. They have replied stating they are not required produce a copy and they don't keep copies of sent notices. It sounds like they are trying to wriggle out of it. Do I have a case here?
  8. My father recently passed away, he had a will and deeds to the house stored in one of two safety deposit boxes at NatWest Bank. I made an appointment to view the contents, when I arrived the bank told me they didn't have the safety deposit boxes and I needed to go to another branch, and gave me the address. I soon realised the branch no longer existed. So I went back to the original branch, who gave me another address. I finally got both boxes, but realised one wasn't my fathers. It belonged to someone else (actually turned out be his brothers). After speaking to NatWest, they said there had been a mistake. There was actually only one deposit box in my fathers name. I know this is untrue as he specifically told me there was a will and deeds to the house in a box at NatWest. The first box has some other unrelated paperwork. What can I do? I have no proof of the contents. The only evidence I have of the existance of the second box is history of two payments of £25 a year.

  10. Yes I wrote to sunny too, they returned the £1 fee and told me it had been assigned to MMF. So if I don't do anything about it will it just remain as outstanding on my credit check? I'd prefer to get it marked as settled if I can.
  11. Well I should really pick this up again.. I still haven't heard from MMF about the CCA. Other than an email offering 35% discount. What can I do now, it looks like they don't have the CCA at all.
  12. I placed an order on the 13/03/2015 with http://www.iflorist.co.uk/ for delivery of some flowers on mothers day (15/03/2015). When I made the order I selected "Free mothers day delivery". As you can probably guess, they didn't get delivered. I made a complaint hoping to get a partial or full refund. iflowers replied by telling me " Please be aware if you opt for free delivery it does state its a 48 Hour Service " I replied by telling them I specifically selected mothers day as the delivery date and I also received an email confirming delivery would be made on Sunday. Do I have any rights to refund as the delivery date was not met?
  13. I know I simply said that as I knew the interest rate of my loan, the loan amount and the monthly payment I was able to calculate the amount of PPI I paid before I received the SAR. PPI = (monthly payment * length of loan) - (loan amount * %interest) Anyway, thanks. I either missed post 13 or it was edited after I asked the question!
  14. Ok, I had already calculated the PPI before I was told to send a SAR. I knew the interest rate and monthly payments I was making (post #3). From this I could work out what percentage of the £136 was for the loan and what was PPI. The total amount is £1,110.67. I'm still not sure what I need to send to Natwest other than the fos questionnaire. This is the reason I asked if I need to send a covering letter with my own calculation of the interest. Or do I just send a copy of the statint sheet along with the fos questionnaire.
  15. I have waited for the SAR.. I haven't done anything else yet! the Document on Natwest's website is the same as the one you mentioned in post 2. The SAR included the attached letter and a few statements, although not going back to the beginning of the loan.
  16. So now I have received the SAR, what is my next step? I have completed the PPI Questionnaire on the NatWest website, which is pretty straight forward. Should I also include a letter with an expected reimbursement figure? Here is the key document they sent me.
  17. I've been away so haven't had time to update this.. They wanted to know the reason for the SAR, and told me that I could access up to 7 years of my accounts online. Although by this point they had already cashed the cheque! I told them it was regarding a loan, and the next day a wad of paper turned up

  20. I have a default of £536 with Payday Express. I CDA'd them and they returned the attached PDF (I've omitted dates/names etc.). the key points I have picked up are; Balance £536 Credit Limit £420 [ATTACH=CONFIG]55297[/ATTACH]
  21. nothing back from vanquis yet but I did get a letter from Rob Way saying the account is closed.
  22. no I didn't.. nobody mentioned sending proof and it doesn't say anything about it in the thread containing the SAR. The address I'm at now (and at the top of the SAR I sent) is the primary address for the NatWest account in question.
