There is so much misunderstanding about dropped curbs/driveways it is easy to see how these disputes get out of handThe facts are:1) It is not illegal to park/block a residential driveway unless one of the following applies:a) There is a local authority restriction in place, for example in Dagenham you can park a car across a driveway and no offence is committed. In the neighbouring town of Collier Row the local authority forbid blocking residential driveways even with the residents own car and you will receive a local authority PCN.b) If a highways restriction is in place such as yellow lines or other parking restriction notice then you cannot park across the drive in the same way as any other section of highway covered by such restrictions.Therefore it's always best to check with your local authority to see if such a restriction is in place or look for highways restrictions.2) What you purchase with a dropped curb/driveway is the right of way, nothing else, you do not own that peice of the highway and you cannot stop people parking there, you can however:a) Ask the person to move their vehicle which they must do each time you ask, whether entering or exiting your driveway, remember you own the right of way and can ask to use it at any time.b) This applies no matter where your car is, the urban myths regarding 'you can't park there if a car is visible on the drive' or 'you only have to move if someone wants to exit their drive' are just that, myths.3) If you ask someone to move their vehicle so you can use your right of way and they refuse then the Police can and should act as the person is now commiting an offence, report it to Plod and they will take action.
