  1. to be honest, the refunding of the deposit onto your card is enough evidence that they have accepted return of the vehicle. any attempt to claim after this point is futile.
  2. Okay, there seems to be a huge amount of referral here to previous cases, and law. IMO, the retailer does not have a leg to stand on. I cannot see any valid argument that the contract is not valid due to a pricing error for the very simple reason that the buyer offered to buy at the price stated, the seller accepted and then the seller despatched the goods after receiving and accepting the payment tendered. The contract has been struck, and completed, by the seller accepting the offer and physically despatching the goods. If the goods had not already been despatched then the outcome would have been different. Spotting a mistake after the fact has no meaning at all. Additionally, should they try anything, there was another seller offering the same goods for sale at a lesser price and, this alone, blows any argument out of the water.
  3. Check your title deeds. As you look out the back door then you are normally responsible for the fence on your left. This is not always the case, hence check your deeds. If they have already had it completed and are asking for payment then that is not on as they should have consulted you first and provided a list of estimates. Good luck!
  4. The seller is stuffed basically. You made an offer to pay, they accepted that offer and delivered the goods after debiting your card. Contract completed, goods delivered. There is ZERO action the seller can take and should they debit your card then it is a fraudulent transaction as you have not given any permission for it to take place. Gordie
  5. Get on to your bank and tell them to do a Chargeback as you have not received the goods and the retailer is refusing to refund. Be prepared to ask for a supervisor as a lot of call centre workers have no clue how to initiate a chargeback. Good luck!

  7. OK, a bit of progress with eBay they have asked for a crime reference number and they will not pursue me for the money, at the moment.
  8. I sold to a buyer, buyer claims damage on the item. Buyer returns item but with expensive parts missing. I refuse to refund, ebay comes down on side of buyer despite the missing parts and now expects me to cover the refund. The buyer is dodgy as he has kept the expensive parts for himself!! what can I do about this as I am not happy having to refund ebay when I do not have the original items returned? thanks.
  9. Yes 1 day is sufficient as flight prices change all the time. You are entitled to your money back in full.
  10. Yes, ask your GP to Fax another letter that says in no uncertain terms that it will be detrimental, and dangerous to your health, for you to attend a medical assessment away from home.
  11. It's a speculative invoice - ignore and don't even bother writing to them and don't speak to them if they phone.
  12. There is absolutely no need to consult about any disabled bay. It is the council's responsibility to do an assessment for the bay and grant its inception, or not. If the bay has been painted in accordance with the correct law then other road users cannot do anything about it.

  14. Yes I have, and received a print out with box ticks as it was all applied for online. They also included statements and copies of T's & C's.

  19. Default listed on CRA April 2010 under AKtiv Kapital, no mention of MBNA on credit file, last payment to MBNA was 2009 I think, need to dig out old paperwork to check. WIll dig out DN as well and post up here. thanks
  20. been going on 3 years now. Original MBNA debt was sold to Varde whilst still in Default Notice period so, sold causing an unlawful rescission? This is what I told Varde and, after a few months, they must have disposed as just about every one else been chasing this since. Do I just ignore Quantum, like I have done with everyone else since Varde? Ohhh, their letter states '...are willing to consider any realistic offer to help repay your outstanding balance'. thanks.
  21. Cleaver - how good is your GP? Will your GP sign a supporting letter for you?
  22. Get onto your bank or card provider and do a chargeback. They have had long enough and you have proof they are lying.
  23. How did you pay? Might be time to start a chargeback claim.
