Any chance you can help without that as I don't feel too comfortable putting up the personal case details. Basically they are claiming they aren't the operating carrier. 1. Court has allowed me to add Finnair to the claim as a joint defendant. Can I take them to MCOL though considering they are a Finnish company?
-
Yes. They are saying the following - "The rebooked flights were subsequently cancelled due to the ongoing restrictions and travel advice on COVID-19." But that doesn't mean they don't have to rebook me. Even if they cancelled due to border restrictions they need to give me the options as per EC261. The claim forms and defence have personal information on there which I would rather not put online. Would be grateful if you can assist without those? I can supply any information that you need.

Had a flight booked via BA but operated by their partner Finnair which was cancelled by them in December 2020. Originally I was told I could leave it pending and call back to rebook when I knew the new dates or claim a refund. Since the flights for Dec 21 were not released then I decided to call back later. When I called back a couple of months back they said my ticket was only valid till September 21 as I bought the ticket in September 20 and refused to rebook me. This is a trip to Lapland and it hardly makes any sense to go before September. It needs to be done around Christmas as it was a winter activity holiday. Spoke to a few people about this and they advised that I take BA to court under EU261 Article 8 Schedule C which says - re-routing, under comparable transport conditions, to their final destination at a later date at the passenger’s convenience. According to EU261 they can't force their own ticket rules onto you as the EU261 supersedes it. The airline is saying I can have a refund but its too late to book the new flights now as they are £1,000pp. Took them to MCOL after booking new tickets and they have replied that it was Finnair who was the operating carrier and that BA are not responsible under Article 8. So I guess I need to go after Finnair but I was reading a thread on here about Ryanair where the OP couldn't take them to the UK court and had to go to Irish court? Finnair says they can't do anything as its a BA ticket and they can't reissue it which they are right about. BA needs to do this after talking with Finnair. What do I do for my case now?

Lease price went up due to cut in govt subsidy.
axil23 replied to axil23's topic in Vehicle retailers and manufacturers
They are willing to cancel the order and give the admin fee back but the price of the car is now £100 more a month so was hoping to convince the leasing company to give me at the old price which they had agreed. -

It says this in their t&c though. So does that override everything or do regulations still apply regardless of what their terms state? -

Although mine is unregulated as its business contract hire so states this I have a email that states I have accepted the quote on the 12th of March. -

It doesn’t state that. Mostly talks about when I can cancel and that is 14 days from acceptance. So does this mean the contract was formed when I accepted the quote and processed the finance? Which was on the 12th of March. -

The lease company are saying "The supplier did not receive your order in time to apply and have your grant approved before the deadline" They are basically saying that Skoda needs to apply to the govt for the refund which they had not and my order was not confirmed till I made the payment for their admin fee which was done on the 18th morning. Isn't my application for finance considered an order? -
I placed an order on the 12th of March. The finance was approved on the 17th and payment taken 18th for their admin fee. The lease broker is now saying that the car price has gone up by £3,000 due to the car costing £35,550 so £550 over the new rules that came into force on the 18th morning. All electric cars over 35k don't qualify for £3,000 govt grant from the 18th. Do I have any rights here? It was a business lease.

I had to get a few tests done and thought it would be better to get them done through the Insurance company. I spoke with them and they authorised the claim and directed me to their approved location. Asked the question from Insurance company as to how much they would cost as I have a £1000 excess and they said they can't disclose contracted rates and its best if I ask the hospital what their direct rates are for paying customers for comparison. Got the bill through and a scan they charge £400 for has been billed to the insurance company for £650. Basically in total a £500 bill for private customers is £800 for the Insurance company. That's a bit extreme.Spoke to insurance company and they are saying I need to pay what their set rates are.. Do I have any rights in this situation?

Contract hire - 14 Day cooling period charges?
axil23 replied to axil23's topic in Vehicle retailers and manufacturers
Lex Autolease have advised me that I do have the 14 day cooling off period. It's in their business contract t&c's. I would like to cancel the finance part of it before the period is over but they won't let me and Lex are saying that I can't do it direct as they don't have paperwork yet. -
Contract hire - 14 Day cooling period charges?
axil23 replied to axil23's topic in Vehicle retailers and manufacturers
I have asked the company to cancel my finance within the 14 days and they are refusing to do so until I pay the cancellation charges which I don't agree with as I was advised that I could cancel. They agree that I am allowed to cancel it as per the terms but won't do it till I pay their fee. I want to dispute this fee but don't want to end up with two finance agreements as I have bought car from other agent. Are they doing anything illegal by refusing to cancel a finance document that legally I am allowed to cancel within 14 days? -

Oh well. I thought that since they allow the 14 days cooling off period for the lease that should also apply to the admin fee. -

Contract hire - 14 Day cooling period charges?
axil23 replied to axil23's topic in Vehicle retailers and manufacturers
It does state that. The reason why I am asking is I have seen people meantion 14 days cooling of period for contract hire which includes the agents charges. -
Booked a contract hire last week via an internet company. Had a change of mind and called up the admin department who advised that I was within the 14 day cooling off period since the car was not due till Sep. Today I got a email from the sales team that they want £360 cancellation charges plus they won't refund my £180 admin fee. I have been advised by a different broker that they can't charge me anything since I was within my 14 day cooling off period. Can anyone advise?

Charged 5% late payment fee by HMRC
axil23 replied to axil23's topic in Self Employment Issues and Questions
This was the first payment on the account for the tax year. So the returns were filed online on time it’s just the payment was late.
