    Ok will do. What normally happens in this situation though? I know he is working full time as but he will just tell them he has nothing and is on benefits.

    I have the judgement but if he says that he is on benefits and doesn't have anything worth much other then a £800 car and some work stuff can they do anything? Is there a way to get him to pay something weekly? Do I need to know where he lives now?

    I had a guy who had worked for me for 5 years. He came to me begging in December for a house to stay in. I helped the guy out by giving him a house that I owned. Cut a long story short he kept the money from the benefit payments telling me lies after lies. I managed to get a court order to evict him. But he still owes me £4000 which I have no chance of seeing. This has sent me in financial difficulties trying to cover the mortgage shortfall. The court ordered him to pay the full amount which he has not. I would really like to get the money off him. I know he works full time but found out later he is claiming housing benefit. He must not be declaring his entire income which will make it hard for me to get the money right? Any help would be appreciated.

    I asked the judge to put the costs in on this claim as it was about to be concluded. he said he can't do that as its a different claim. I explained to him that its not but he did not agree and said I need to seek that separately.

    Yes its proceeding. Another hearing date will be sent out soon. I thought that since he did not send out his case to myself and the court the case should have been dismissed?

    I did. It was about to be concluded this time around when the judge suggested we do 50/50. I was going to agree subject to the fee being included but the judge refused to put that fee in. He said it needs to be a separate case.

    I did. He said that I would have to wait till the court hearing to see. Last week at the court hearing I brought it up and was told that they can't do anything about that as its a different case so they won't discuss it in this case. BTW The claimant never submitted his case to the court or to myself. I never got any of the documents he was going to use in the court. The judge took his word for it that he had sent them even though the court itself did not receive any documents. I asked the judge to set the case aside as he did not follow the courts requirements but my request was declined. The judge has again asked him to share the information and we will have another hearing.

    An electrician who had worked for my dad did a claim against him but got the names wrong and also included me on the claim for some reason. He also did it at a address that we moved out from 5 years back so we never got any of the correspondence until one day my credit report got hit for a 6 and experian sent me a email. Cut a long story short it took me 3-4 months but I got the CCJ set aside but at a cost. He is now following up the case but I want my court costs back which he refuses to give. What are my options to get my court costs back from him for the case to set aside the CCJ?

    No trial date yet. So what should I do to comply? Shall I send him all the documentation? Or wait to see what the court says?

    Spoke with the court. They have not received anything from the claimant so the case has been referred to a district judge. They have received the photos and statement of truth from me. What does this mean? Does the judge now take a call whether the case will go ahead or not?

    To be honest the whole case history is that he was sending me letters to the old address. the judge asked him to send all communication he had sent me in the last 3 years to my new address which is all that I have got. These are copies of old letters he sent asking for payment. I did not see anything odd in that as the judge had asked him to send these to me. He has not sent me any witness statements or any other proof he is relying on in court.

    Yes I got there a couple of weeks back. Way over the 28 days allocated by the court. he is late too. There is no trial date. It states on the letter that they will allocate the hearing date and let me know.

    Must have been a mistake no they have not inserted a date. Although I think its pretty obvious what the date should be. 28 days from the posting date which was 2nd August. There is no trial date. I have not heard back from them. The letter just states Notice of allocation to the small claims track (hearing)

    Interestingly enough it says the following - The parties must provide to the court and to the other party or parties by 4pm (insert date twenty eight days after typing) the following.... The court clerk must have typed this one up in a hurry that she did not put in a date.

    You are right. It does say that. I am not sure how I missed it. Is there anyway to limit the damage now?

    Yes that is the last notice that I received. That is also the one that I replied back to the court with a copy of the photographs to which I have referred to in the witness statement. I just checked the paperwork and it does not state that I need to serve the papers to the claimant. This is what I am asking. Do I need to?

    Sorry what I meant by that was a copy of all pictures that I wish to rely on. I did not keep a copy of the witness statement.

    It has been appointed to the court and that is the documents that I was referring to. Replied to them 2 months back and yes I have kept a copy of everything I have sent. My question is do I need to send copies of the photos to the claimant too?

    I am really confused. someone has done a CCJ against me. I got the paperwork to either admit it or defend it. I filled in the courts documents and posted them off to the court with the required photos which I would like to use to defend my case. Thats all that I have done. My question is the photos that I have taken do I need to send them to the claimant too?

    It was a good couple of months back. Can't remember exactly but in brief it was an explanation of why I thought his work was not what I had asked for and of the quality that a new product should be.

    Sorry I am not sure what you mean by that? I got a letter from the court that asked for my part of the story and asked me to sign a statement of truth. My question is that in a CCJ case do I need to send any photos that I will be using in court on the day to the other party too?
