  1. If you've already sent an LBA and the 14 day deadline has expired, file your claim at Court NOW. Stick to your timetable so that they know you mean business, otherwise you'll either get ignored or fobbed off or both.
  2. If the account is closed, you will be sent a cheque. Or, for an open account where they owe you more than the account balance, thet will pay off the balance and send the remainder by cheque.

  4. Good luck LIP. I'm at the same stage as you and Pual Denham is also dealing with my claim. I haven't received my AQs yet, although I guess they might arrive in today's post. Will keep a close eye on your thread.

  8. You'll need more detail than that. Are you claiming online or using form N1? See the library for guidance on what to submit... Guidance You could also search other threads - but I think most of us have followed the advice found in the library. hth
  9. Letter from DLA waiting for me when I got home. They have sent copy of their defence, which looks standard. Also an offer of 50% - £3133.84. oooohh, so tempting - but I'm after £6000ish in total, so it'll be no thanks. just waiting on the AQs now.

  11. I can't help with the default bit I'm afraid, but I remember reading advice from a MOD about responding to partial offers after MCOL has been started. It's in Dessie V Abbey thread, from about post 40 onwards. (Hope the link works)

  14. I don't think it really matters - as in theory all letters should be forwarded to the correct dept. If you are hand delivering your LBA to a branch, I would ensure you get a receipt for it. If you want to post it - the address is: Customer Satisfaction Centre Abbey PO Box 5129 Milton Keynes MK9 2YN Send it via Royal mail Special Delivery, just to make sure it gets there. Peace of mind and all that.
  15. I know it sounds confusing, but the more you read, the clearer it all becomes - honest! Start with the FAQs... I assume you've sent the Prelim and LBA letters from the library? Once the 14 day deadline for the LBA is up, you can file your claim with the court. There's lots of sound advice on this site, and I really do recommend you have a good read around so that you know exactly what you are doing.
  16. It's up to you of course, but you WILL get the full amount back. Lots of us have had offers such as these from Cap One...the general concensus seems to be that if you want the lot back, send a polite letter stating that you are willing to accept the £200 as partial repayment, but will be pursuing the remainder through the Courts. It WILL be worth it. When your 14 day LBA deadline is up, file your claim with the Court. But, as I say it's your call!

  18. hi all I have an MNBA card issued via Abbey. My question is... Is the address for SAR the same regardless of which Bank has issued the card - and if so.. what is it? sorry to be thick.
  19. Quick and Easy! I followed the steps and they paid up without a fight. Payment arrived safely in my account a couple of days after MCOL was acknowledged - didn't threaten to close my account. £721 + interest + costs. Thanks guys x
