  1. Follow London1971's advice and ignore the bailiff for now if they can't gain admission there's not a lot they can do unless there is a car they can clamp.
  2. Good point LFI Beavis does indicate that to be the case, notwithstanding that due to Covid 19 provisions it would be a virtual impossibility for anyone to not breach the parking time Llmits set by fleecer's whilst shopping etc. Parking Eye's default Aldi 90 minutes was impossible to comply with due to a one in one out maximum 6 in store and queue's around the car park. There is nothing to indicate this situation was not the status quo at that car park.
  3. when you say OPS have refused to provide the required information that's when maybe broach the LOC for breach of SAR.keep calm its not adversarial in the manner of a US Courtroom drama or Crown Court
  4. They are on a hiding to nothing with that one as LFI indicates No POFA compliance so cannot be transferred No appeal people out themselves inadvertently as Driver with appeals quite often.
  5. The most they can have from the Keeper is £100, that's if they can make A case, with an airport no stopping a prohibition cannot form a contract, nor in reality should VCS have any jurisdiction where Bye laws apply.and follow what DX FTMDave and LFI tell you
  6. Post those copies up, and one thing to note is that as the amount is so large they will send a HCEO, like DCBL but as already stated they hab=ve no right of forced entry, and keep any car well away for time being and any garden furniture locked away if possible.
  7. Yes quite an expose that one oink oink snouts down chaps.......There is talk on Twitter of a posse and a hanging judge.
  8. D Richard North's column has highlighted Bailiff's aka Enforcement Agents have been engaging in shenanigans still, and that the MOJ Reforms have not made things any better according to an MOJ report https://consult.justice.gov.uk/digital-communications/review-of-enforcement-agent-bailiff-reforms/results/government-response-call-evidence-enforcement-agents.pdf Politics: the coming onslaught | Turbulent Times WWW.TURBULENTTIMES.CO.UK One of the more unpleasant features of the domestic energy price hike is rarely given enough prominence by the media or the politicians. And that is...
  9. Definitely Judge lottery, some of them are not up to speed with the shenanigans and misleading of the couirt by fleecer's LFI's points should be part of any appeal, as in Judge failed to consider the fact POFA not applicable, not relevant land and VCS have no jurisdiction.
  10. perhaps checking MCOL again for claim status might be an idea, they would be extremely silly to submit that guff as LFI has given an absolute dissection of their argument that would be excellent in a defence WS if they actually had.
  11. There we go, as was assumed another frightener, they would be stupid to actually submit that garbage.
  12. Having read through the PE missve that passes for a WS, I have to concur with FTMDave and DX it initially is a ramble through Beavis taking it out of its contec=xt as many other fleecer's do, its not a universal automatic case winner at all, and can be used against a fleecer equally when they do that. Seems that many judges are now awake to PPC shenanigans, and one reading that might lose the will to live after the big expansive ramble on beavis.
  13. They might but its unlikely, what they might do is send frighterner's like a letter saying pay up before court as we will be asking for an extra £250 in costs when they win, that's garbage as costs limited on Smalls Claim track thatwill not help them in court.
  14. They will pull out all sorts of rubbish but if road isn't Relevant land, and Bylaws apply POFA doesn't and they have no right to access keeper data. They have no jurisdiction on a Public Highway as already indicated a contract cannot be formed from a Prohibition stopping is not parking.
  15. If you do as Nicky Boy asks and acknowledge the claim on MCOL, don't worry about defence right now, that will be a simple 3 line one but under no circumstances do you Counterclaim.
  16. makes no odds as the only place they could have sourced the data is DVLA so whatever DVLA say or do is immaterial to the claim.
