  1. I think thats what they call themselves now. I have 2 accounts, one which was formerly Kays and Additions. I fell behind with them due to redundancy and they haven't been much help TBH, but one thing they did ask me to do was to put the whole amount that I owe into a loan with them at a whopping 39.9% APR. Well of course I don't want to do this. Thing is, should I have a signed agreement with them? Something that is legally binding? I am fairly sure I haven't signed anything?? ANy help appreciated. p.s wasn't sure if I started this thread in the right place ?

  4. Hi Letter to reject their offer was sent by recorded delivery on 9th MArch. They have not responded. What is my next move? Letter before Action? Cheers Deli x

HI all Just been looking at my account with these wonderful people I was in arrears for a while due to circs, now, I checked and i was paying an extra £50 per month to clear this and I have just found a letter from January that shows we owed them 60.30, so in my reckoning the January payment of an extra £50 and an extra £10 in Feb would clear it! However, they have continued to take the extra £50 and when i spoke to them this morning she told me that i have to apply in writing to claim the extra £40 back - ridiculous!! Ihave lodged a complaint with them cos she also said that they would have continued to take the extra until i advised them otherwise, because they cannot change my DD until i say so! i told her that was crap and that would only apply if they were increasing my DD not reducing it back down - she then said well its to stop you getting bank charges - how can i get bank charges form them REDUCING my payments! Muppets!!!!!!!! It is now with a complaints handler - who will apparently call me back within 24 hrs!
  7. Shall I just write out to these refusing the settlement and stating that I want the full amount and if they do not pay up then I will take further action? Cheers

  9. I was about to update this. Got a letter from them enclosing a copy of a letter they said they sent to me back in December but i never received. They have just said that they deem their charges to be fair basically, so i need some advice as to where i stand now and what is my next move. Can anyone help?
  10. Thanks very much Scott, thought as much so will continue They are still playing silly games with me on my account tho! and i am still being chased for payment, however, i am standing firm and telling their solicitors to bog off as my account is in dispute. Cheers for your help Deli

Update I went out to CAP1 for refund on this old account and they sent me a letter stating "the OFT has not challenged the right of banks to charge default sums, just the level of them" They are basically saying that they reduced them to £12 in 2006 so will only refund the difference for the ones previous and have offered a pathetic £72 as opposed to the 800+interest, came to over £1000 we were asking for. What should our next move be? can anyone advise? Thanks Deli
  12. yeah made quite a difference, about £250 - £300 a month! but as I say it was only *allowed* for 6 months. Why not give them a ring and verbally request it first and when they ask it be put in writing tell them that you have done and that you have had no response. Be firm with them, as they no doubt are with you if you are behind! I have wised up to this company now and will not take any abuse from them (I got £50 compensation from them last week after putting in an official complaint) If you get no joy from the call then I would also recommend you send it recorded delivery, also mention that this is not the first time of requestingin your letter, telling them that you have verbally requested it as well as written in but never had a response. Give them a couple of weeks and then go to the ombudsmen. They did mine almost immediately.
  13. What reason did they give for declining? Me and my hubby got into financial difficulties last year as he was out of work and I contacted them and I put it in writing that I wanted to go on interest only, it was sorted, no questions asked. It was for a 6 month period only though as thats all they seem to allow. All the best hope you get sorted.

  15. eventually received back the SAR. I have checked and there are plenty of charges and what I find strange is, the card was taken out in 2002, and yet in 2003 suddenly some payment protection charges were being added, all of it in total adds up to over £800, can I ask for the payment protection back to, we obviously didn't take it out to begin with as it would have surely shown up in the 2002 statements?
  16. Phone calls daily now from a company called SPC? I think. I don't do security, I just say stop calling, account in dispute, and I hang up.... The first person I spoke to with SPC said to me that it was irrelevant that I did not have a true copy of an agreement, I had the money so I needed to pay, so I told them to do what they want as I was not satisfied that they had supplied me with what I asked for! muppets...

  18. Hi there, Can anyone advise me? I am a bit confused after the recent rulings etc. I wrote to my mortgage company on 23rd November asking for my charges back. Gave them the 14 days but I have had no reply at all. Am I now sending a letter before action? Can this still go ahead? Any help would be appreciated. x

  20. Has anyone looked at the above and can help at all? Also, had 2 calls from them today over the same account, now he has just told me that the letters that they are sending out today carry a £25 charge per person on the account! So me and hubby, £50 for them to tell me i am in arrears that i know about and have an arrangement in place for? also they tell me that i am on verge of litigation where they will send our files to their solicitors? what the? They actually broke an arrangement a couple of months back not me! When i complained they phoned me and asked would i accept £50 compensation that I have to date not received. These are pure muppets! grrrrrrrrrrrrrr
