  1. Well, we're in court tomorrow. I have received nada from the defendant. He's also cut off his phone. Up to know I have 13 different numbers he's using through advertising on gumtree. He's also still claiming he doesn't live were I know he lives despite the fact I have his deed and he's signed for documents in his own name there!
  2. Lol she's now saying IM in "breech of contract" for refusing to come to a meeting with two of them after two hours notice. Didn't even give me time to arrange a witness. She's also "speaking to are legal team"!
  3. So now there saying hey have an agreement with "their client" that they can "change the employees terms at any time for any reason". On what planet am I boind by a term in someone else's contract? o_O

  6. I have never been mobile. Always been on the same site with the same hours. I'm the keyholder for the site! Yes, the new one would be permanent.
  7. The only thing I can see that relates to flexibility is "your place of work will be mobile at any client premises where the company has contracts" And Your normal hours of work may be varied in addition to those above.."
  8. I've already told them I will not be working these shifts. I have uni to go to and the shift clashes, they were well aware of this. As far as I know monday is my last shift. They said they'd " keep you informed" but I've not heard a peep.
  9. Thanks for the reply. I am employed, for just over three years. Contract specifically says 'evenings' and has no flexibility clause (silly!)
  10. So, I've been on this job for three years working evenings, which my contract states. The site is moving to a new building which has been in the pipeline for a while. I've repeatedly asked for information but literally been ignored by the company i work for. So I've just now had a phone call. The site is moving ON TUESDAY and they want me to switch to mornings. I can't do this. I have other commitments as they were aware. We're do I stand here? I've said they'll have to make me redundant to which he's refused saying I've "turned down the shift change". Surely essentially changing my contractual terms with four days notice isn't legit?

  12. As stated in the original post, all avenues have been exausted and early notification has been done with acas, they are also ignoring acas.
  13. Yes, three weeks ago one of the replies said "your comments have been noted" I specifically told them the comments were clearly not being ignoref and I would therefore want to make a formal grievance-then laid out all the reasons why. Just to add, I am still no further forward!
  14. I've been here before, were the other party has taken the mick and the court have allowed it.
  15. So, I've been working for this company for five months. They do their payslips online which is fair enough only I am not able to access them. In five months I've been able to access it once. The system is rubbish, spins back to the login page a lot and won't let me change passwords. The company have been made aware of this and done nada about it. It took me weeks to get the login details out of them! Ive asked for printed copies to be sent and got nothing. There was one night were we couldnt get in due the street being cordoned off because of an accident. So when I did see some of my payslips they have put this down as holiday hours despite me not asking for any holidays. I was under the impression the case law says when you are ready and willing for work and the work is not provided they have to pay? ( Beveridge v Klm U.K. 2000) My wages have also now been incorrect three times, I'm missing a fair bit. Also when someone is off, they don't send cover and the staff that are in get time and a half. This isn't mentioned in the contract but has been paid previously. Hasn't been paid this time though. I did two peoples jobs for two weeks and been paid min wage for it! The other two I work with want to go early everyday, and because we have to clock in the company are now saying we only get paid when logged in. The problem I've got is one of the staff members who wants to go early is the keyholder. So if she goes early, which she does every night, I'm left with no choice but to go to, and lose pay. The only other choice I have to get my contracted hours is to be locked in the building over night!!! Clearly that's ridiculous. The company are aware of this but have done nothing about it. I really don't think it's fair for me to lose wages because someone else wants to go early. Not really sure were I stand with this point. I was under the impression they have to pay contracted hours even if the work isn't provided? I've brought these issues up with them several times, I've sent 21 emails over four weeks and several phone calls. Managers say they'll come and see me about it but don't turn up. Also being met with a wall of silence to emails. I've even emailed the CEO and been ignored. Been on the phone to human resources today and been given the regional managers phone number but he's not picking up sonive put it in writing via txt message. I've done early notification with ACAS but they appear to be ignoring them also!! Not really sure what else I could possibly do?!
  16. Well, today' was the deadline for me to receive his copy of the questionnaire. The post has been and gone and I've had nada. He's also put in a change of address with the court. I have proof of were he actually lives by way of his deed and he's yesterday signed for docs in his own name.
