Hi R Exactly!! What is strange though is the amount of caggers who have heard nothing for years and now are being chased by lowell.The CAP1 thread seems to be on fire at the minute, maybe they need to chase some bad debt to cover all the other bad debt they have bought Regards

hi DD The application form they sent me in response to my Cca request is dated April 1999. According to My SAR the account was opened a month later. Thanks for looking at my thread

DD I agree I've just been done by IND who got a CCJ in quick time as I had chosen to ignore them. I'm not saying that had I argued every point they would not have proceeded but it would have give me all that time to prepare.

Andy In your very knowledgable opinion are lowell less likely to press ahead once they have taken the legal route and filed at Northampton or other CC if SHB has been issued an application form in reply to the CCA request Regards

Been reading through the cap 1 threads and everyone seems to have different versions of the t&c's. Mine are V3 but they did not form part of or were with the application form when I forwarded it in 1999.

Hi, Just so you know... Unfortunately I received the exact same letter and two weeks later they forwarded me an application form with a demand for payment. Since then they have been chasing me hard with the last communication being a LBA. Lowell seem to be very busy in the last six months

Hello Further correspondence this morning stating the next stage will be legal action, I know that what they supplied me with for the CCA request I sent them is an application form, however IND have just got a CCJ on me with the same peice of rubbish. Therefore I want to head this off and I cant find a template for 'mere application form' letter with up to date regulations. Your help would be appreciated.

Hello again I have had a reply to my SAR of lowells and it isnt on Cap 1 paper but they reckon I made a payment in Septemeber 2009 which was a random payment of £5 the one previous to that was july so its not statute barred until this that time this year. Does anyone think the letter the great cerb supplied in post 5 should be sent? Thanks

Yes Andy The form was completed on the 15th ans it was delivered by hand on the 17/12/2014 issue date was the 10/12/2014.The baliff advised me the court have advised the claimant to question the form but wasnt willing to divulge what that was. They informed me the claimant would contact me directly. I found the whole thing quite bizarre.

Hi Andy I have had further correspondence from the court re this after submitting my statement of means. I got a letter ordering me back to court within 3 days or face possible imprisonment. I have been this morning and the baliff informed me I will have to attend court again(date to be set) to answer questions to the court re this statement. I havent told any lies the debts/bills I pay with my wife are all true so im not bothered but in the meantime I want to know if you think its worth offereing a reduced settlement to them and ask my parents to supply those funds to me. If so d you have an appropriate draft I could send or would this upset the court/ Regards

Hi Happy christmas. Lowells say they have bought this debt, I requested a CCA and they originally sent me a letter back saying Cap 1 did not have it and they were removing me from their files. Today I received the above application form Cap 1 originally sent me with a demand for payment. A couple of things I could do with someones help with as follows; 1) I have not received a notice of assignment from Lowells do I need to request it. 2) Do I send them the letter in post 17 or something different 3) This debt may be statute barred as it is around 6 years since I paid on it how do I find that out. Ok Andy As I said thank you trying to help. I would have paid them more over a period rather than this CCJ it's monumentally bad for me. Hopefully all who read will follow instructions on this site to avoid being in the situation I now find myself in. Regards

No I think he said the original order would stand but he said that after he told me he wasn't setting aside and tbh my thoughts were elsewhere after that

No, he refused to award costs and asked the agent to discuss payment terms he didn't make a court order for it but the agent said they had a court order for an attachment of earnings and that will be a very very serious problem for me. However I haven't seen the court order but she assured me they have it. Also Andy what will the date of the judgement be? It's original date or the date of the refusal to set aside?

Ok thanks Andy I'm at the mercy of IND this CCJ will affect my prospects going forward. Should I start another thread to see how best to get IND to satisfy the debt ?
