  4. You paid £4k for this car. 2 weeks after buying it you get a significantly expensive fault. Take them to court. 7 days letter before action required.

  6. Nationwide bans are usually done by way of a photograph of any one they wish to ban. When I was a store detective at B&Q we had an entire wall in the security office of people to watch out for. On occasions one would get spotted and they would simply be escorted off the premises. The shop can ban anyone they do not wish to serve.
  7. I am not so sure. I believe duty of care of valuable items/documents rests with the person who has been entrusted with them until they are safely received by the original owner.If DVLA chose to simply put a passport in a standard envelope and sling it in the post, they have not acted with care as Royal Mail will not compensate for the actual replacement value of the passport, their liability being limited to 10x the postage stamp used, ie £41 if first class.
  8. DVLA only supply the registered keeprs name and address, exactly as it appears on the front of the V5c (registartion document). Completely ignore these clowns. The fact they obtain your details is to frighten people. DVLA do not support them in any way at all. DVLA just acept their £2.50 for your information. DO NOT make the mistake or writing back, telephoning or in any other way responding to them. You will now get a series of fright-o-grams, from reminders, to final warnings, to final, final chances, to final ever last chance ever final oportuinites. These will be in varius disguises, like Debt collectors (woah, so scary) or even solicitors (woah, really frightening). Bottom line is you owe them sweet fanny adams. Be as worried about their con as you are of owning me that fiver still. What fiver? Exactly!
  9. There is no requirement for registered post as the law is cleart in this respect. Once you have posted it, your legal requirment is fulfilled. If it gets lost, stolen, eaten or anything else, that is DVLA's tough doodies. Invite them to take you to court where you will file your defence because you have done all that was legally required.

  11. Your contract is with the seller, not the manufacturer. 'no refund' policy is illegal. You can only refuse a refund if the item is software or music/video that has been opened, however if that item is faulty the buyer can still demand a refund. In this case, I must asume you have bought a very special bit of kit for that price. If it doesn't work as intended then it is faulty and you are entitled to a refund. retailers like this often believe that they have the right to change a consumers rights. They do not. the law is very clear and if they refuse to refund, take them to court. I would take the unit to a reputable dealer of similar items and show them the fault. Do not let them open it or take it apart, just get them to agree (even verbally but ideally in writing) that they have seen the fault. failing that show a solicitor or a trading standards officer. Keep a note of the serial number. The T&Cs are laughable. You cannot demand that a consumer is at the absolute discretion of the seller. Ridiculous in the extreme. EDIT: If you paid by credit card (not debit card) the card company is jointly liable for your loss.

  14. It is an interesting question. I honestly do not know, but I believe thay have no legal right at all to touch any car. However, in an emergency situation it is unlikely they would actually be prosecuted for criminal damage even if they did scuff your alloys etc. Their insurers would (I presume) cover any claims for the purpose. Clearly it is a cse of priorities, someones life has to be more relevant and important than a replaceable car, but as far as legislation is concerned I would imaging it may be more along the lines of excemption in a similar way to police and red lights. No actual right to go through, but won't be prosecuted if an emergency etc. Only my opinion I must emphasise. Interesting question though.

You can and always have been in a position where you can be prosecuted for failing to stop at a red signal if you cross the 1st white line into the cyclists area whilst waiting for a green signal. There are always two solid white lines with the cyclist area between at this type of junction. If you cross the first white line and the stop before the second, you have technically failed to stop at the red signal because 'stop means before the solid white line'. Not, 'stop before the second solid white line'.

  17. The first thing to establish is whether this was a genuine 'private' sale or not. So, I am asuming you now have the V5c in your name. Is the previous registered keeper the same name and address as the person you bought the car from? Next, is the garage you took the car to. Are they a VOSA MoT testing station? If so, then their opinion is valid and you should contact VOSA immediaetly regarding what is clearly a dodgy MoT. Lastly. Have you contacted the seller at all? If so what has been their repsonse?What did you pay for the car and do you have the original advert from which you responded?

  19. So, at Christmas when I buy my presents I should complain 2 weeks later when the January sales are on? You bought at the price advertised. If the price had gone up would you be happy for them to now ask for more?
  20. Bev50uk, read the original ticket. If it say XYZ Council, then itis a council ticket. If It says something like Central Parking Ltd or National Car Parks etc, it is a piece of toilet paper and should be treated as such. OP. Ignore the next series of threatograms too. You have done the right thing to ignore so far. the ONLY think a PPC can sue for is their losses. In your case they have lost £4. You offered to pay their losses, but they declined. I guarantee that a county court Judge will not be impressed with them. Thatg is why it will never go to court. Do not make the mistake of responding to them again. I have been receiving letters from clowns like these for years. None has ever taken me to court.
