It should be upto HC to pay for the cost of the hand writing expert. As far as your concerned you didn't sign it and if they can't proove it and are not willing to pay for the cost to proove it That should be the end of the matter? Possibly write to them and the court and tell them that you are not willing to pick up the cost.- 23 replies

I have just read the Carey v HSBC case - it states the below which I think will refer to me. Specifically, s61 (1) provides as follows: s61 (1) "A regulated agreement is not properly executed unless: (a) a document in the prescribed form itself containing all the prescribed terms and conforming to regulations under section 60(1) is signed in the prescribed manner both by the debtor or hirer and by or on behalf of the creditor or owner, and (b) the document embodies all the terms of the agreement, other than implied terms, and © the document is, when presented or sent to the debtor or hirer for signature, in such a state that all its terms are readily legible." -

Ok Been researching Credit agreements. My application form has no cancelation box, no prescribed terms and conditions, It does however have my signuture. My case so far is this - The Default Notice is not effective because it has added charges included and HC have not sent all the paperwork, as well as an ineffetive credit agreement Is this right? -

to be honest i only got this on Thursday which was the 23/01/12. it is dated the 15/01/12. There reasoning is that they cannot supply this this and have stated this on the letter -

You may receive a leaflet after the case hearing tday to ask if you want to consider arbitration however, I received my offer of arbitration after submitting my first defence and never went to Court in the first place. What is arbitration? -

No he didn't. The solicitor did advice the judge that there were no more statements pending. I asked that normally when the judge issues an order barclaycard are able to print out these statements. -

Ok.. so the statements are to be provided. I dont suppose you can remember the case he quoted where the T&Cs were acceptable? He couldn't remember the case and asked the HC solicitor if he could remember the case. The HC solicitor said he could not remember either.
