  1. It should be upto HC to pay for the cost of the hand writing expert. As far as your concerned you didn't sign it and if they can't proove it and are not willing to pay for the cost to proove it That should be the end of the matter? Possibly write to them and the court and tell them that you are not willing to pick up the cost.

  3. I have just read the Carey v HSBC case - it states the below which I think will refer to me. Specifically, s61 (1) provides as follows: s61 (1) "A regulated agreement is not properly executed unless: (a) a document in the prescribed form itself containing all the prescribed terms and conforming to regulations under section 60(1) is signed in the prescribed manner both by the debtor or hirer and by or on behalf of the creditor or owner, and (b) the document embodies all the terms of the agreement, other than implied terms, and © the document is, when presented or sent to the debtor or hirer for signature, in such a state that all its terms are readily legible."

  14. Ok.. so the statements are to be provided. I dont suppose you can remember the case he quoted where the T&Cs were acceptable? He couldn't remember the case and asked the HC solicitor if he could remember the case. The HC solicitor said he could not remember either.
