It sounds bloody horrible, but all I can say is that you will feel better for fighting it, maybe not today , maybe not tomorrow. but soon (LOL can't resist a great quote!) there are loads of people here that are experts on employment law and can help practically, the rest of us will support you as long as is required.     I dont know whether they actually have to prove it, fairness would say yes, of course they have to prove it, hopefully someone should be along shortly who will be able to answer.

    A sorned car has to be on a private driveway or road that is not publically maintained, i would say that were you are keeping your car is publically maintained and so it liable for a fine, I would suggest that you move it immediately. Having said that, if the DVLA are saying that your car has been seen somewhere that is can't possibly have been, well, they should be able to prove it shouldnt they.
  6. It must be a truely terrible time for you, but even though your boss said that this is more than she needed, this is now on your permanent record and that is where is can cause the most damage.

I sent the letter and the cheque because we were in the wrong, it was only £35 and we had nothing to loose, as it was, the Council were very accommodating, cashed the cheque because they had to and then issued a refund in the amount of the fine, all I am saying is that if you have no grounds to fight, then it is worth a go.

  9. It is statute barred if there has been no admission of the debt or payments towards the debt for 6 years (5 in Scotland ). I would ignore them and if they send anything more, post it up here, but there is a letter to send them but I dont know where it is anymore, someone will be along that can advise you further, but the debt is definately SB'ed.
  10. Even if you did make those payments, the latest was 2000 - 9 years ago, 0f course it is statute barred !
  11. Well what you can do, is send a cheque with a letter stating that you only left the car for a few minutes to get some change, make it a nice letter stating that you will pay but appeal to their sense of fairness. Worked for me!
  12. Whatever the position 1k is far too much for changing a cam belt, £120 perhaps, I would ring around and get a few quotes.
  13. Was the case in the high court ? if not, then noprecedent is set, but I would continue to use the same arguments and paraphrase what the presiding judge said.
  14. Are you a member of a union? if so I would suggest that you contact them immediately, print out your report above and show them.
  15. You pay to take a chance, and we all have the same odds of winning, I dont agree that it is a tax on anyone, because you have a choice, unlike most taxes, sound like an awful lot of sour grapes going on here.

Well, he is bound to say that isnt he, just another way of intimidating you, as long as it has been a trading name then I am sure that a judge isnt going to be too pedantic over it, if the co is a subsidiary and is known by your husband as the one used then I am sure it will be ok, the judge will be used to small traders with multiple companies trying to put one over on him.

I would say that the only way to stop this in the short term is to change banks completely, I would still fight for the return of the money, if you havnt authorised the payments from your new account I dont see how the bank can authorise it for you. and I also think that Ida's comments are not helpful in the slightest, Sky have not lost out, nothing is being "stolen" and the service is being paid for.
  18. Santander are refunding charges to Abbey customers? when did this start and does it include those that are stuck in the court system?
  19. Your only recourse might be if the ticket was incorrectly issued, but in all honesty, just because you have done it before and just because it was only for 5 minutes, doesn't make it ok. Perhaps in future you should not park in a bus lane, I hear that this is a ticketable offence.
