  1. Try talking to your branch. Explain that you cancelled direct debits so as to avoid this situation. It worked for me this month - £90 back. But still battling for other £1400.

  4. Just because they have requested a stay it does not mean the court will grant it (although this is likely). Wait for the court decision and then apply for the stay to be lifted. Post on here when you hear from the court and you will be pointed in the right direction.

  13. At the moment it would appear to be up to your local court. It may not be a quiet time as there are things you can be doing if a stay is granted. You need to keep an eye on this site for developments.

  15. Wouldn't bother asking for a transfer at this stage. Just need to wait and let it take its course.
  16. Wouldn't put too much hope in phoning them. Sometimes helps as a one off but not for a whole load of charges. Same has happened to me and I'm starting a new claim. OFT case may meen waiting over a year but at least you are at the top of the pile.
  17. I don't know why this still surprises me. They took £30 off me on 1st August for charges leaving me £28 o/d. 2nd August they bounced a d/d for just £4.58 . So another £30 going on in September!!!!!!!!!!!! I'm almost as mad with myself as I am with them; thought I had cancelled all direct debits. Oh well - another £30 into the high interest savings account (£455 plus 8%)
  18. See post 174 from Gary. I think, with the situation after the OFT test case, I would be inclined to request a strike out. In my opinion, Lloyds are hoping that after the re-allocation they will be able to request a stay (essentially treating it as a new court claim). Of course I may be wrong. Hopefully, Gary will be able to offer more help.

  20. You should be able to find the address in Yellow Pages (other directories are available!) under County Court.
  21. Two letters received from Andover re; my business account. Usual rubbish plus a bit extra - the second letter mentions UCTA AND UTCCR; I haven't mentioned these! No replies on personal account to my 2 letters!
  22. Can't see a problem with that. Just make sure you move or cancel all direct debits to stop any further charges. Start action straight away so that there is no question that the account is in dispute. If they start phoning, refuse to speak to them other than to say, "the account is in dispute." Thinking this through, on personal accounts, they could have lots of problems with hundreds of accounts in dispute and they won't be able to discuss any of them
