  2. Rebecca, it sounds like you might have to fill in an N244 for this now as you are ammending the original claim. Speak to the Court and ask their advice, if that's the case, it will cost you £35 (non-claimable) so bear that in mind, but it might also be worthwhile if you add your personal ac claim to it as well. Mod's help may be required, poss PM BF and ask their advice? BC:confused:
  3. Flyboy, Sounds like a non-compliance case as well then (just check your 40 day calculation from when they received it)!!! As for your statements, I'd give your Branch a call and ask to speak to the Assistant Manager and explain that you have requested the statements, paid the £10 and nothing has been received, ask them to chase it up. This worked for me and they refunded the £10 and the statements arrived about 7 days later. BC:cool:
  4. Oo-er Rebecca, not sure about that, cos would it still be below the £5k Small Claims limit? You may be better off keeping them separate, which isn't ideal considering your future life-plans. I'd be tempted to ask a solicitor about this one, seeing as you have submitted an MCOL, you could submit an N244 Application Notice to the Court to include your personal account claim. Sorry if this doesn't help. just thinking out loud before I've finished my 1st coffee of the day.... BC:p
  5. Steve, sounds like the standard letter, you will be passed on to Tommy Mclean soon for another preprinted letter. I'd start getting your ducks in line for the MCOL if I were you. You can start the MCOL and save it ready to go back to and just press the GO! button as your deadline passes!! BC

  7. Hokey cokey! Spoke to HBOS yesterday, several people and got a bit of a run around, the usual "not my department, I'll try and transfer you" bolles!! Eventually I spoke to a very helpful chap called Andy who looked at my file and told me the following: Yes they had recieved my letter rejecting their offer. It had been passed on to the Customer Relations Team, Stage 2(sounds sinister eh!?!) on 1st Sep. They should have written to me (No!). I shall now be writing to the following: Halifax Plc Customer Relations Team(Stage 2) PO Box 548 LEEDS LS1 1WU and no doubt be issuing my MCOL against them in 2 weeks time.... Back into battle then, LBA to HBOS ready....... BC:cool:
  8. Flyboy, if you've sent your DPA Letter requesting your statements or list of charges and you've had nothing back after 40 days then so far you're OK. The problem now is acsertaining whether the Bank recieved the letter or not. If they deny all knowledge and you didn't send it recorded delivery than you have a problem. If that's the case you have 2 options: 1. Go after them for non-compliance with the DPA request. 2. Start again, using your branch, sending the DPA letter (3rd in the template list) again, recorded delivery or in person(obtaining a delivery receipt) and giving them 40 more days. The Branch should normally action this quite quickly, but it will take about 7-10 days to get your statements. The you spend the weekend in close proximity to your statements and a highlighter> Your call! BC:cool:
  9. Right, that's it! RBS have charged me another £388 since I started the MCOL (thanks an extra £20 of interest @ 8% too!). I'm awaiting Ms Burgoyne giving me a call back so that we can discuss these extra charges and see if we can reach an 'amicable' settlement! BC:p

  12. Martin, I'm just musing over sending Ms B an email informing her of my intention to raise an N244 for further charges incurred during this faff. Is that a good idea or do you think I should give her a call or just complete the N244 and let the Court decide? BC:?
  13. DD, 1. Are you in Scotland? If not then MCOL 'limit' for Small Claims is £5000 before interest. If north of the border, then yes chuncks of £750 seems to be the way forward, best thing to do is check out some of the other threads based in Scotland (sorry I can't be more help). 2. Court-wise, the general feeling is that the Banks do not want to go to Court and recieve adverse press and legal rulings. However, there is an expectation of a test case against somebody at some time. Until that first test case hits the world, don't worry about it too much. There is also the Court Buddy system operating on CAG. Just keep reading and getting to recognise the Bank's way of dealing with us. If you spot anything different or out of the 'ordinary' then blow it to the world for advice, guidance and warning to others. That's the way we operate, mutual trust, advise and respect.... And anyway, if you've just posted your DPA (hopefully to your Branch, and recorded delivery) then you have got months of process to go through before you get near a court! Bon Oeuf! BC:p

  16. But have you sent Template 1 and 2? What have you asked for. Tell us in simple words what you have done so far. As for your £10, was it a cheque, has it been cashed? If not, call your Branch and cancel it. Deal through your Branch and you should minimise any further problems BC:p

  22. No, you should be OK as long as you now keep to the timescale and the procedure. Have you sent the DPA to your Branch? BC:p
  23. Richie, have you read the FAQs? If not do that first. Have you got your statements? If so, have you highlighted the charges and put them into one of the spreadsheets? Have you requested these charges back nicely? If so then update your spreadsheet and send in your LBA. BC:p
