  3. Hi, have you tried ringing .... I did a couple of weeks ago to be told that a full settlement letter would be sent out, but when I rang this week to find out where it was they had changed their tune (or rather Thomas Hickey had) saying that there were at least 100 claims for the 14th and that Barclays had not decided upon their policy yet (see my previous posts) and to get ready for the hearing.. ! Its a directions hearing so I thought that we did not need to do the bundle yet... try ringing on monday and post what occurs! regards, Jenny:???:

  6. Yes, see my previous posts (dont know how to enter quotes!!) - I phoned Thomas Hickey two weeks ago to which I got a good reply of will be settling - then when I rang him this week his tune had changed and basically get ready for court!! So bit confused and worried !!
  7. ah treble sorry to hear that - a friend went down that route and then decided enough was enough so made herself bankrupt, now she only has to pay a 1/3 of her debt spread over 3 years and will be discharged by xmas. Good luck, might see you on the 14th !

  9. Treble, not sure but would it not be the case that RBOS 'sold' on the debt to the debt management company, that the debt is now with them and not RBOS? - need some legal advise me thinks!! Can any one ans my query on SAR I have not asked for a S.A.R - (Subject Access Request) as I already had 6 years bank statements - should I do so anyway? My original letter said if they disagreed with my figures to provide proof - is that sufficient or have I missed something!
  10. I supose we have a long wait as the hearing on the 14th is for directions which I presume would mean a hearing date later in the year. Is anyone going to attend on the 14th and if so are you going to take 'the bundle' or is that not relevant at this stage? Welshcakes, are those 3 active claims you listed 'links' coz they dont open? I emailed Tom Hickey this afternoon and gave brief details of a few of the Cardiff claims that had been settled, this is his reply: Dear Jennifer, Thanks for the email, but I am afraid that I have no idea which cases they all refer to, and of course I am not allowed to discuss anyone else’s claim with a 3rd party. I can also assure you that I am not dealing with any Cardiff cases at the present time, and if any of my colleagues have already then I am sure they had good reason for doing so. Thanks, Tom Any ideas on what to do next?

Linda, I've just got off the phone from Thomas and go exactly the same reply - that as there were so many hearings for the 14th (he said about 100) that he (Barclays) did not have a policy yet on how they were handling the cases. I reminded him that he said I would have received a settlement letter about now and he seemed to have no recollection of that, also I said that Barclays had already settled some claims that were listed for the 14th (I presume from here that they have?) again he did not know anything about these and even said if I had more information to let him know.... basically he told me to be prepared for the 14th and sorry that he could not give me any more information. So if anyone listed for the 14th had received their money back...PLEASE POST HERE and let me and Linda know!!! .......now what do I need to prepare for the 14th ???

Hi, I rang Thomas yesterday and he was very friendly and said that I would be receiving a full settlement within the next two weeks, providing that my figures tallied with theirs..... fingers x then! With regard to fees incurred since the listing he said to phone Customer Services as ask for them back ... doing my adding up and will be making a call!

  18. Cardiff update: I rang Dino today (nice young man) who informs me that Tom Hickey is dealing with my case, but he is on holiday till 25 June. So I have mailed a copy of my Draft Directions and a polite letter asking them to pay up my 4.5K to him, but looks like I will have to wait till he get back off his hols for a response! I have been successful with a smaller claim on one of my other Barclays accounts, claimed £255 plus interest by letter 4 May. 4 June received letter offering £250, so accepted and banked within 3 days! No court claims needed on this one.
  19. Hi all Cardiff Claimants, I am so pleased to see that I am not alone!! My date is also 14 August at 10.30 am. I have just rung the court to clarify a few things and was told that there are 500 cases listed for that day (200 have already settled) and this tactic by the court is in hope that the banks will settle the others before hand. Those which are not settled before the hearing date will then be given directions for another hearing. I will be therefore sending to the court and to Barclays my suggested case directions and will also be attending. My claim is for £4,500 - would appreciate hearing from anyone with a similar amount and any backup support/strategy etc.,
  20. thanks for help.... u know what I really just hate banks, barclays in particular, here I am juggling my money around just trying to make the accounts under the overdrafts, and when I try to move the money I cant access it coz its not a working day, well when the hell did barclays computers shut down and where in the sky is the money, making more profit for them no doubt!
  21. Hi, fairly new to this group myself, but it looks like Barclays have extra time to file their AQ and if not then yes, judgement will go against them. Barlcays were late delivering their defence on mine and when I rang the court I was told that the defendant takes precidence!!.. Good luck!
  22. Hi, Ive just received a 'General Form of Judgement or Order' from Cardiff County Court stating that they have made this order of its own initiative without a hearing... it is ordered that 1. Directions will be given in this case by the Designated Civil Judge, (Judge G Hickenbottom) on 14th August 07.... 2. The parties may appear in person or make written representation as to how the case should proceed provided a copy of the representations is sent to the Court and the other side at least 7 days prior to the hearing. Do I now send the 'Directions' only, or should I back up with other info.... I did send with the AQ a form of directions, based on the info on here... would like to hear from anyone who has had similar experience!!! thanks Jenny:confused:
  23. Getting ready to complete the AQ, but the more I read on here the more involved it seems! I read that it is a good idea to attach directions for the court, is this applicable for small claims court. does this strengthen my case or will the judge automatically make directions? Also, I think I worked my interest out wrongly, would it best to carry on with the amount I have claimed as I have now read about contractural interest and if this is the case I think my amount is probably ok - sorry to be a pain but new to this group but the information I have read is brill.
  24. Thanks for the advice. I did attach my spreadsheet to the claim form, the copy the court sent back to me had it attached as well. But I will phone the court on Monday and find out if it was sent to Barclays.. will keep you posted!
  25. Hi, Re Barclays Bank After writing to Barclays requesting a refund of my bank charges, I rejected their offer £1,000. I then filed a Claim Form in the Cardiff Civil Justice Court setting out the particulars of the claim and also attached a spreadsheet of all the actual charges made with dates to my account totalling £2,851 plus interest (which I hope I worked out correctly) bringing the total claim to £4,543.99. Barclays had until 30 March to respond. On 2 April I filed for Judgement against them as they had not responded. I phoned the court 12 April to see what the next step was, only to be told that my Judgement form was being returned as Barclays had filed a defence, received by the Court on 2 April - I queried the date, but was told that 'a defence takes presidence'. Today I have received a Notice that a Defence has been filed and a Allocation Questionnaire to complete. Also attached is Barclays Defence Statement. Its rather long winded and full of legal jargon, but starts by saying that I did not provide details or particulars of the preceise charges alleged to be unlawful or the date thereof...... I was wondering if anyone else has got this far, and need some help on what to do next.... obviously I will complete the Allocation Questionnaire which will then result in a date for the hearing...do I need an expert....help, please!!
