  1. Thought I'd check on your claim... I think they are just covering all their T&C's.. but it is definately something you could use for wasted costs order... Shows that they didn't treat your claim as individual but just used a template defence...

  4. Hi Simon I don't think it makes that much difference if you are sending them a spreadsheet of charges as long as in your letter you don't include it in the amount. I sent my spreadsheets (showing the growing interest) but didn't ask for the interest until I had started my MCOL.

  6. yeah, already had another claim (shabbey) transferred to local county court and just waiting for court date now. AQ has been dispensed with.
  7. bit of a long saga but I have to ask for the basics as I'm at work and don't have time to fill in the blanks..... So does anyone know if there is a regulator I can refer to that deals with Auction Houses? I wrote to the house in question over 1 month with no reply.... Any advice would be appreciated.
  8. Too optomistic by far! Offer was 500 quid less than I wanted and no mention of taking off the charges since I submitted my list of charges which is over a grand.. Oh well onto County Court then
  9. Thanks for the "Bump".. but I got a phone call and letter from Woolwich so I'm going to get them to confirm to the collection agency that there is a dispute. Also spoke to the collections agency and they are now aware of the situation so all taken care of. Waiting for a call back from Woolwich at 12 to give me an offer. I know what I'm willing to accept so am hoping that I won't have to submit my N1 form this week afterall.
  10. Hi Did you send a list of charges with dates, amounts etc already? Are you sure they received your last correspondance? It seems to me they are asking for the breakdown rather than statements. Also if they are asking "how they are calculated" this is surely something that must be asked of ABBEY as they are the only ones who know how the charges are calculated...
  11. *Bump* Did they have to submit an AQ to the court as well? Is this what you received or their Standard defence? if they were supposed to and haven't then I'd complete the notice of issue.

    Finally a letter from the court saying my claim has been transfered to West London CC. Also looks like AQ has been dispensed with so now I just have to wait for WL CC to get in touch with further directions.
  13. Bumped for you. It's moving quick now isn't it. Sorry can't help with your queries as my allocation questionaire has been dispensed with. Just waiting to hear from my local CC now regarding next directions.

  16. You will most prob get the 65% offer with the defence like quite a few of us have. If I hadn't read the letter properly I wouldn't have even noticed it was there. U should be asked by the court of any dates you can't attend. Just imagine could be all over this time next month... Yipeeee.

  19. Hi Lee Just thought I'd let you know that my defence got filed yesterday with a 65% offer.. Looks like they are sending them as standard with the defence documents.

    I think I would for 50 quid less....Would cost more than that to take half day off for court case! Might give it a try though when the date comes through. Not expecting it to be that quick though as I started a small claim against a building contractor a year ago and had to wait over 7 months for the court date!
  22. I am at the stage of waiting for a reply to my LBA. Have about a week to go. I owe around 200 on my account but have just had a letter from a debt collection agency asking for 1216.82. In my letters to Woolwich I have asked that they remove any charges which were pending or charged after my first request for refunds. Does anyone have a good letter that I can send to the debt collection agency as I think some of this amount is their fees and I'm not going to pay them as the Woolwich were aware the account was in dispute before they passed the debt onto them! Any help would be appreciated.

    Today was the deadline for Shabby to file their Defence.. was really hoping they wouldn't do it in time... but they have. Suppose I'd better start getting my AQ together just in case!
  25. I have used the MCOL and then just sent a seperate sheet with my charges to the Court and asked them to attach them to my particulars of claim.
