  2. Does anyone remember the Barclays 'Assent' card which was around a few years back? It worked like a store account card, in that you had a set monthly payment to make, and you were allowed a credit limit of 24 times your payment. The reason I ask is that I had one, but apparently it flopped, and all the 'Assent' accounts were transferred to Barclaycard. That's how I obtained the card relating to the above, er, 'CCA' - I don't ever remember actually applying for a Barclaycard! So, have I signed this as a 'formality', or is there something sneaky going on? I'd appreciate it if anyone can tell me when the Assent card was around.
  3. Provided you want a referee playing for the home team! Typical of the CSA's position is that 'it is up to each member to decide how far to comply with the Consumer Credit Act' your referees should be Trading Standards, OFT and FOS. Not to mention your local District Judge....
  4. By 'trade association' I assume you mean the CSA? Don't bother with them, they'll be no help to you. Set up BY the DCAs, FOR the DCAs! nor should you EVER speak to them on the phone! All communication should be in writing, because that's evidence!

  10. when did the debt reach statute barring? you should remind them of that in your letter. They KNOW the rules, they're just trying to bluff you, hoping you DON'T know!
  11. Well, if you want to make them establish their right to collect the alleged debt(s) then a CCA request is the way forward, rather than SAR. If they DO have all the paperwork in order, then you should make an arrangement to pay what you owe. If they DON'T have it, then you have a bit more bargaining power, as they can't enforce the debt in court. That DOESN'T mean that you don't owe the money. If you just want to take credit from people and not pay it back, well, that's debt avoidance, and that's not what this site's about!
  12. NEVER deal with them on the phone. If you do everything in writing from day one, then you have a trail of avidence to back up your complaints to Trading Standards and the Office of Fair Trading, not to mention the Information Commissioner's Office.
  13. Get the S.A.R - (Subject Access Request) off asap and get the account in dispute for unlawful charges. Capquest will be breaching OFT collection guidelines if they chase you for a disputed account. They have 40 days to respond, so the sooner the better.
  14. Was the agreement in HIS name or BOTH names? I was under the impression that if the debt was his alone, and it got to the stage of bailiff involvement, then bailiffs could only take goods from the address of the debtor. BUT don't quote me on that, I'm no expert. hopefully a legal eagle will be along soon.
  15. That's my thinking exactly. Besides which, if they can't produce in six weeks, my guess is they don't have it at all !
  16. You should have had your agreement, plus t&c and copies of any document referred to in the agreement, and a statement of account with payment schedule. Rarely does anyone get a full set!
  17. Your CCA3.doc clearly contains the terms: 'please issue me a Crap 1 credit card' and 'if my application is accepted....' amongst others. It's clearly a pre-contractual application form, NOT an agreement, despite the title. As for the rest? well blank templates, anonymous screenshots and undated t&c prove nothing.
  18. Well, all the prescribed terms seem to be there, but did they send you the T&C, which forms part of the document? It's incomplete if they didn't. sosumi, I've seen that letter before, too. Think it was on here somewhere a month or two ago. By the way, what's happening with your claim now? I assume you've sar'd Egg to claim for charges, is that right? how much do you expect you'll be able to claim back?
  19. well, call me cynical, but I think you've been 'specially selected' for this generous offer because they have no enforceable agreement, and they know you're on to them! File under 'ignore' for the moment. the main issue is your CCA. do you know if it is valid? Can you post it up here for checking?

  21. I agree totally! There are far too many 'get-outs' for determined non-payers, and no help for the recipients who should be receiving payment, but are not. (see above!) But they're great at hitting easy targets, like my own case, which now has Eversheds chasing me again! AAAAAAARRRGGGHHHH !!!!!!! Enough said, back to the thread......
  22. What is your claim for? Is it for non-compliance with your SAR request to the bank?
  23. ....and yet, I see why they do it. My sister's ex-husband, a self-eployed builder, has paid not a single penny towards their two sons in the ten years since they split. If he couldn't drive his white van, who knows! Also, my partner's sister's ex has not paid towards his two sons for fifteen years..... he's a taxi driver! I'm beginning to see the sense here. Mind you, both of these t***pots escaped paying because they're self-employed, and spookily manage to make almost no money! (never mind that aforementioned builder drives a brand new BMW... flies to Florida for 3 weeks every year... and has a holiday home in spain!) Don't call me a CSA apologist; I have my own issues with them, which regular posters will know already! The whole system is rubbish, and they're trying to fix it with the kind of measures which are about as appropriate and effective as putting an Elastoplast on an amputated leg! Sorry, ranting again... what IS it about the CSA that makes me rant? Oh yeah.... EVERYTHING!!
