  2. why must it be unenforceable? I have an agreement that is enforceable for over 12 years and the lender has never taken action
  3. Just to update that DLA claim has been received and being processed. We have had the formal diagnosis and this has been sent with the IEP ( nursery/school programme) to the DWP. The education officer has helped us with form as well as imputed on it. Thanks all x
  4. well the OP viewed the thread today so quite surprised they would feel inclined not to update
  5. email the address that Rebel gave you state that now you have been informed that you could have been directed to the free wireless connector page to try and claim a free connector and also that if you had upgraded to movies on the 1 months free trial offer that you could have claimed a free one as well and ask for a refund of the original costs and confirm when you will be receiving the replacement one
  6. Not much to say except the system should hav picked up what box you had and selected the correct connector for you , never read any that has been incorrectly ordered before. Sky.com chat service is this pits and I am aware that the chat service is being overhauled. Do u have movies at all?
  7. Done : ) Link to thread if forum if needed for you http://www.consumeractiongroup.co.uk/forum/showthread.php?419497-Used-car-gasket-blown-after-4-months
  8. Your claim would be against scott and co as they are the "instructors". I take it you have been calling them? If it was me I would write to them copying in the council and your local MSP requesting the confirm the balance due and when you will be receiving the refund. I suspect any refund due would already be placed on to your next council tax billing.
  9. Its only a small claims so you need to fill in the part where you are disputing the debt and return to the court for the alloted date http://www.scotcourts.gov.uk/rules-and-practice/guidance-notes/small-claim-guidance-notes you also need to send this to the persuers In the XXXX Sheriff Court Pursuer -v- (YOUR NAME) Claim Number: (CLAIM NUMBER) Dear Sirs REQUEST FOR INFORMATION I have today received a court claim from your firm as referenced above. In order to file a defence and counter claim I require some further information from you. Given that this matter is now the subject of legal proceedings, I request you to provide me with the information and documents detailed below. I request that the information should be furnished within fourteen days of the receipt of this letter. If you fail to comply, it may hamper proceedings and result in me filing an unnecessary defence or counter claim. 1. You are requested to supply me with a true copy of the executed credit agreements to which you refer to in your claim together with any terms and conditions that applied to these accounts at the time they were opened and at the time of alleged default. In this respect, your attention is drawn to the compliance of such documentation as prescribed under Section 78(1) of the Consumer Credit Act 1974 (herein referred to as “the Act”). 2. All records you hold on me relevant to this claim, including but not limited to: a. Transcriptions of all telephone conversations recorded and any notes made in relation to telephone conversations by your firm. b. Where there has been any event in my account history over this period which has required manual intervention by any person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my account formerly held with American Express Services Europe. c. True copies of the default notices. d. Details of any collection charge added to the account; specifically, the date it was levied, the amount of the charge, a detailed financial breakdown of how the charge was calculated, and what the charge covers. e. Specific details of the fees/charges levied by any other agency in respect of this account and a detailed breakdown of said fees/charges and what each charge relates to and on what date said fees/charges were levied. f. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998 g. A list of third party agencies to whom you have disclosed my personal data and a summary of the nature of the information you have disclosed. h. Copies of statements for the entire duration of the credit agreements. 3. Any other documents you seek to rely on in court. I must advise you that if the information is not forthcoming, it may delay or frustrate the equitable resolution of this matter and result in unnecessary cost for both parties. In relation to the above, I draw to your attention to my previous correspondence with your Client and the numerous agencies that they have instructed in relation to this matter. Your Client has not fulfilled their obligation under Section 78(1) of the Act. The documents previous provided to me under a Subject access request do not conform in form or content to Section 60(1) of the Act and as such are not enforceable under Section 127(3) of the Act. I also refer you to the Consumer Credit (Agreements) Regulations 1983 (SI 1983/1553). These regulations set out the form and content of agreements. For an agreement to be compliant with the regulations it must embody within the agreement, the prescribed terms laid out in the SI1983/1553. Your attention is brought to the fact that I have requested such documentation from your Client and their agents in relation to this matter. Should your Client continue with this action this documentation will be brought to the attention of the Court and my previous attempts to avoid legal proceedings. You need to edit as appropriate I would also send TSB a SAR request as well as back up. I would also suggest you look through the threads and read up on small claims to gain an understanding of the process
  10. so the summons was sent to the wrong address? so how do you know about it? was it a previous address?
  11. sorry i don't understand? Sky unlimited broadband is £10 per month. If you have sky tv this is discounted to £7.50 per month. So by going by your pics you only have phone and bb and not talk so you are being charged the extra £2.50 per month.
  12. You need to decide first if you wish to defend the action and on what basis or if there is no basis to defend the payment options
  13. I would request them to listen to the call and if the agent mentions hd in the 12 month deal they will need to honor it, if the call is available. Just to show other side you said it was to include the hd but then you say believe which would mean to me you are not sure now. If you know where am coming from Have you contact Sky?
  14. Sky actually made an error and left the hd pack running on customers account without charge longer than should have been. These customers now have the option to pay for these channels or lose them. If you have an online account with sky I would suggest you check your emails from sky recently as you may have been offered this at half price as well. Back in october your HD channels would have been free so would not have been included in any "deal".
  15. Sky do not do 18 months contracts. Sounds as though you had a 6 month offer that has ended. You would have been left an order confirmations sheet by the sales agent , do you still have this? You would have also been sent "here is what you will be paying " letter from sky, do you still have this?
  16. It will show you at financially linked Has the inhibition order now fulfilled and when?
  17. Personally I forgot about trying to rebuild my credit rating and lived within my means as not doing that got me in trouble in the first place.....it will be 6 years before your credit rating will improve anyway
  18. You need to defend the action as statute barred as it wouldn't be unheard of a claimant saying they will withdraw and don't.
  19. Ok thanks on 1 2 they get paid middle rate and does not earn near £100
