  4. Make/Model: Seat Ibiza. Advertised on Autotrader. The MOT is a new MOT, it was tested at 'The Garage, Crown Street, Accrington, BB5 0RW' on the 19th of July 2023. 78,578 miles. The testing organisation and inspector's name: S004011 MMC MOT STATION, K. Mehrban. Car cost: Just under £3,000. Paid by bank transfer on delivery. The reason it was delivered is that he said he would get it valeted - the car was a little dirty when we test-drove it and agreed to buy it. Other than the car having trouble starting from cold, it 'appears' ok. I think it's either the fuel pump or the pump breather valve.

  11. Thankyou very much for this. I do appreciate the time you have put into it. I did read the estoppel thread a few times to try and understand what it meant. Yes she did take the overpayment in good faith and wasnt nor wouldn't have been aware of this had she carried on in her employment with no further sickness events and felt the need to go. She left under mutual agreement with the manager who said she needed time to get better, and agreed that she wasn't the happy person who had started there several weeks previously.

  12. It's true that she's under the two-year rule for most employment-related tribunal issues, but remember her statutory rights apply from day one of employment and, further, cannot be contracted away. The most common example of this is discrimination on the usual legal grounds.

  14. She is 29, has multiple health issues of which the company were aware at the interview including Fibromyalgia , ADHD and Autism (linked to learning). She started working with them a few weeks ago with no training, which she was suposed to have. She was reprimanded a couple of times by one of the directors in front of customers which left her visibly shaken. Several occurences of bullying happened in the time which eventually made her ill. She had several days off, on one occasion she passed out in the store and an ambulance was called. The management were happy with her work but the attitude of the director made her ill. She mutually agreed with managers to eventually leave. While under employment legislation we know she was under the 2 year rule, there were several shortcomings. The company is Specsavers.

  17. OK, I've hidden my post above which is misleading. Talking of misleading - so the first sign says "Patients & Visitors Only" and then suddenly you get a second sign with "STAFF ONLY". It's obvious patients will get confused. Did you park in the first part before the "STAFF ONLY" sign? Also, can we see the PCN please to see what the fleecers are accusing you of? The charlatans will not pursue people living abroad, so I have an idea. Let's see what you e-mail exchange produces first however.

  19. Well – Big Fail! If you had come to us as soon as things started to go wrong we might have been able to sort things out. It's not as if we were going to charge you £300 an hour. We do it for free but this kind of thing just makes us work a lot harder then we need to. Please post up the claim form in PDF format and also your defence in PDF format. How long is the report? I suppose you had better post that up in PDF format as well

  20. you do know you can take npower to court if they refuse to honour an sar for data they must hold encompassing the last 6yrs without good reason. no holding it it NOT an excuse if its within that timeframe. also under the prevention of fraud act, the money laundering act and the data protection laws, they must retain all data for 6yrs.

  21. Just had a look back through the thread and only seen 1 photo and there is no "period of parking" stipulated on any of their rubbish paperwork. BPA Code of practice: 13 Consideration and Grace Periods 13.1 The driver must have the chance to consider the Terms and Conditions before entering into the ‘parking contract’ with you. If, having had that opportunity, the driver decides not to park but chooses to leave the car park, you must provide them with a reasonable consideration period to leave, before the driver can be bound by your parking contract. The amount of time in these instances will vary dependant on site size and type but it must be a minimum of 5 minutes. "Parking fully within a marked bay" may have been one of the aforementioned "terms and conditions". Soooo, the driver quite possibly left the car park within the 5 minutes "consideration period", did they? Your daughter, the keeper, probably won't know. (She may not have been driving the car.) The fleecers have to prove that the driver stayed more than 5 minutes, so were there any more (time stamped) pics? Only asking because in post 58 you said... "images taken by attendant" (plural).

  23. Well done on wanting to prepare well in advance. Your case is atypical, I can't remember a specific thread to guide you towards - but also every case is different. You need to expand on the legal arguments explained in posts 59 & 61. There should be something in the fleecers' trade association's Code of Practice about not entrapping motorists if you look it up.
