Morning all

I recently requested my details from MBNA whom I have had no links with for a few months. I wanted to double check that I had no charges on the account so I sent off the normal DPA letter. This morning I received a letter saying....

Thank you for your letter dated.....

We attempted to contact you by phone to confirm exactly what information you are seeking. However, I can confirm that there have been no default fees (late, overlimit or unpaid) charged on your account over the last six years. Therefore, please find enclosed your £10 cheque.

Should this information not be sufficient, and you wish to make a full data subject access request under section 7 of the DPA 1998, please complete and return the attached form.

I am happy that this is true and will not pursue it futher. However, I was wondering if maybe when the DPA letter is being received the banks know what is coming and are therefore cutting straight to the chase?

Just a thought.

NEW Barclays Bank claim - £80 requested. LBA not acknowledged yet. 14 days have passed. Moneyclaim about to be dispatched for second time.

 

Barclays Bank - £2155 requested. LBA acknowledged and awaiting response. Offer of £875 made and refused. Moneyclaim issued 20th June 2006. Court date issued for 15th November 2006. £2325 including costs.....and growing at 39p a day

 

Amex - £15 refunded.

Halifax Credit Card - £25 refunded.

Co-Op Credit Card - £25 returned. Credit file amended.

Similar response.

 

We have attempted to contact you by phone to confirm exactly what information you are seeking. However, since we were unable to reach you, we have enclosed copies of your statement information dated back to August 2000. If there have been any charges on your account as a result of manual intervention, they will be included on the enclosed statement.

 

On this occasion we have provided this information to you free of charge and have arranged for a cheque for £10 to be returned to you under separate cover.

 

Should this information not be sufficient, and you wish to make a full subject access request under section 7 of the Data Protection Act 1998, please complete and return the attached form.

 

Included with the letter was a list of all the dates, amount and types of charge that had been applied to the three accounts I held with MBNA, which appear to match with what I believed to be the case.

MBNA - Agreed to refund £970 in full without conditions. Cheque received Sat 5th Aug.:D

Lloyds - Settled for an undisclosed sum.:D

I have had exactly the same letter. I spoke to Gareth Tunniciffe and he said that they believed people only wanted their charges so they were sending that first. If someone wanted the full DPA they would process it for them!

I pointed out that I couldn't tell what interest had been charged on their unlawful charges but I would send him a letter without that figure at this stage. I put this in my prelim letter

"I would like to point out that I have also been charged interest on these charges, which, if the matter is not resolved by this letter I will be reclaiming and asking that my original DPA request be actioned correctly.".

Will wait and see what happens.
