  2. 2 weeks tomorrow until court now. Did I mention that my court letter never actually arrived? I called the court on the off chance and they faxed the letter to me. I am now wondering if Barclays received their version? I guess I will find out over the next few days. My claim has gone up by about £50 since the original Moneyclaim. My other claim is ticking along at the expected rate. My first request was turned down flatly. I responded in the usual way. I actually got the first amount wrong though so it has increased from £80 to £105. I have refered the lady at Barclays to my main account to demonstrate my 'resolve in addressing this issue'. We will see what happens I guess. It does seem that the banks have moved on from being surprised we are asking to being fully prepared for the procedure and hanging on as long as possible. Anyway, more updates as an when they happen.
  3. Barclays will issue a defence very late on the third. Then maybe it will be reassigned to your local court for a court date to be issued. This might take another month or so. Then a court date is issued no earlier than 3 weeks after the date of issue. Thats my experience so far. I was issued a court date today (16/10/06) for the 15/11/06. Good luck
  4. Hi Good news and thanks. They do seem to take it to the wire each time. Its about 40p a day so that is some consolation I suppose. This could have been sorted months ago though. I offered to settle for less than my claim but did not receive anything back. I will keep the forum posted. BB
  5. I have today recieved a court date. The 15th November is the big day. Almost 5 months since the original Moneyclaim was sent and almost 8 months since the whole thing started. And it is still not over. It been a couple of weeks since I last logged in - is it still the case that no-one has been to court on this matter? As always, any help or guidance always appreciated.   6. Mine went to a freepost address in London. Yet is being dealt with by Northampton CC. I would not worry. You will know in a couple of days if they receive it or not as you will get the Acknowledgement of Service letter. I say - don't worry. But I am happy to be corrected......anyone??
  7. Exactly what has just happened to me!!! After I posted here I went to check and low and behold a defence. I had the option to start judgement this morning! Well I guess its another 28 day wait now?!?! Or is it. How long before the court assigns a date? If this goes to court you're all invited! We'll hire some coaches and make a day of it. Oh well lets look forward to the post in the next couple of days. BB
  8. :confused: All change now. I just went into the moneyclaim site and whereas this morning I had the option to enter judgement I now don't. It is now saying that Barclays had entered a defence and the case will proceed to court. OK so be it. But they literally must have been standing on the steps ready to hand in the defence at 11:59 last night. Hey ho. On to the next step I guess. Will keep you up to date. BB
  9. I am at exactly the same point as you. Original notice 21st June. Acknowledgement of Service filed 23rd June. I rang the Moneyclaim Line this morning and they said go ahead with entering judgement. I don't believe it is working days - the lady this morning was very helpful. She said that they then have a calendar month to pay up. Quite frankly if they wait another month then it will only cost them another £11 in interest charges. I have not tried it on the Moneyclaim website yet though. I will respond here later on once I have tried. FYI - my thread is BBloke v Barclays. Good luck BB
  10. Hi I got to this stage and they did not enter a defense in time. The deadline was midnight yesterday. I will be entering judgement via the moneyclaim site later today as per the advice on here and from the moneyclaim phone line. Sounds as though you are a week or behind my claim. Apparently they could now claim they did not receive the paperwork. We'lls see what happens. Good luck BB
  11. Oops! OK. Won't speak to him when he calls. I was hoping to receive a letter from them yesterday. It seems a lot of people get the last minute letters. I will enter judgement today. I believe that they have a calendar month to pay from judgement. Is that correct? Unless they apply for it to be set aside I suppose. Oh well. Lets see. Thanks though.
  12. OK....more updates.....and its getting interesting now! Notice of issue dated 21st June 2006. Total claimed £2150 including £350 interest and court fees £120 so £2275 plus 39p per day thereafter. Next, Acknowledgement of Service filed 23rd June 2006. They are stating intention to defend entire claim. Signed by Keith Jeremiah, Legal Executive. Barclays then have 28 to file a defense. Midnight last night (24th July 2006) the deadline was up. I called the court this morning and nothing has been received by me or the court. I was advised by the court to enter judgement against Barclays. I have called Barclays this morning and am waiting for Keith to call me. So, do I ask them nicely or just proceed with entering judgement. The lady at the court said I should just plough on. Does anyone have any other suggestions? I guess this is all over bar the shouting now??? Am I right in thinking that Barclays cannot contest this now??? Thanks in advance.
  13. Morning all I recently requested my details from MBNA whom I have had no links with for a few months. I wanted to double check that I had no charges on the account so I sent off the normal DPA letter. This morning I received a letter saying.... Thank you for your letter dated..... We attempted to contact you by phone to confirm exactly what information you are seeking. However, I can confirm that there have been no default fees (late, overlimit or unpaid) charged on your account over the last six years. Therefore, please find enclosed your £10 cheque. Should this information not be sufficient, and you wish to make a full data subject access request under section 7 of the DPA 1998, please complete and return the attached form. I am happy that this is true and will not pursue it futher. However, I was wondering if maybe when the DPA letter is being received the banks know what is coming and are therefore cutting straight to the chase? Just a thought. BB
  14. Evening all Just a quick note to say that today I received a letter from Halifax comfirming my charge will be credited back to me on my next statement. It was only £25 but it all counts and still add to the momentum. Keep the faith people. Survey - check Donation - pending £2k from Barclays absolutely. BB
