      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

you're EXACTLY right about the dent in my car.

So glad it was MY Car that was dented though.

Went for the Double !!!

Two cars in one household on the same day.

 

Reversed back into my partners car a few weeks ago.

he was standing in the kitchen looking out of the window

watching it happen......in slow motion...... :eek:

 

our son said - his dad's mouth opened wide

and he was trying to pull out hair he no longer had !!!

 

I jumped out in panic on the jolt !

thinking i'd run the bloody cat or dog over.

he NEVER normally parks his car there.....

so it was 'his' fault !

and I just took it for granted he hadn't that day.

 

ran over to see impact

to try and 'kiss it better' !!!

quickly spat on my fingers

to try and rub out the scratching on m's car.

then tried rubbing it better with my skirt !!!

Horror of Horrors.....

 

fortunately our son managed to save the day by

polishing and polishing and polishing with specialist materials.

 

my bumper bit hit the spokes on his car and it just caught the upper wheel arch, and theres a nasty crunch in my bumper now turning rusty.

 

until not long ago - I was driving around in

an old moggie minor !!! :p

 

Oh how i loved that car.

she had trafficators !

 

was forced into a new car when our son

was learning to drive.... one with ABS.

 

 

she came to me ready named by her

previous owners 'little blue'

still miss the sound of the revs on the old girl

and the noise of that lovely engine

tootling along.

 

and you'll NEVER believe this

but i used to have

MICE living in the car, ha ha ha ha ha

 

I have NO SENSE OF DIRECTION whatsoever

if someone says turn left.... I've already done a right !

and roundabouts, - especially the big ones :eek:

the one lane roundabouts are fine....

 

 

I drive with birds flying around my head

only ever do Two local towns

and if I'm ever driving and theres a Diversion on

thats me finished !!!

OMG again - are you my doppleganger?

Once when driving my OH back from a do - he made me drive on the motorway - by not telling me ( drive faster here pull out) too late i was on there. THEN he fell asleep :eek: I went into a blind panic as I had no idea where I was:evil:

 

now I use SATNAV if I am going anywhere I dont know - helps a lot:D

our son has just bought a Satnav

 

because he has - unfortunately

inherited my lack of sense of direction.

 

and its BRILLIANT

 

even when you don't do as she says

she doesn't shout at you

she just gives you the next turning

she's lovely

and very patient

 

trouble is

I can't figure how to work it

or programme it

or put in the addresses yet.

 

 

Give me time.....

I've only just learnt to TEXT !!!!!:p

...I tried texting once, it took me 30 minutes to say one sentance.. gave up in the end and called them instead, its much easier.

Hello Ladees,

 

Sorry I could not make it yesterday as the Goblins had locked me in the garage and had to spend the night in there until released by Tessie bear in the morning.

 

Sorry for the couple of mistakes re Jenny, resignation and not, but I was so looking forward to the picnic, that I got carried away.

 

William seems to be a bit of an enigma, is it Williiam or something more feminine? If it is a William he sounds as if he is very much on top of things. Car would have to be something practical and would be the love of his life. Passengers would be a rarity, and the car would always come first.

 

Dewit who? Very girly, car would be an extension of her, fluffy toys and cushion covers, maybe pink would be a nice colour theme. Have to give some more thought on this one.

Mimi Jane's car.

 

Bit of a puzzle that one, crystal ball too fuzzy to make out as she spends most of her time flying on 'Gossamer Wings'. When not flying by herself prefers to use the 'Acorn and Dragonfly Express'. When earthbound prefers to use a smallish vehicle, brightly coloured to match her personality one or two cuddly toys but no dangly bits. A careful and considerate driver, but will only drive out of necessity.

Sorry about the car Jansus,

 

Since I have been having this treatment different images pop up all over the place. You strike me as the 'Woman in Black' whether it be schoolmistress or barrister. You are hard on the outside but soft on the inside, but you only show the soft side to those you know and trust. The Saab is Your type of vehicle because it is an extension of you, it is a very safe, tough and reliable vehicle as you are too.

 

Alice, it was a toss up between the Moggy or the 2CV Dolly, I chose the 2CV Dolly as Alice struck me as a repressed 'Hippy', she may have missed 'San Francisco' but still has time to join the Colony in Ibiza. Drives without a care in the world, the Moggy would have put Alice in the Brigadier's daughter category (twin set and pearls), I saw her more in the present 'laid back' (flowing Kaftan and beads) category so a 2CV Dolly with flower imprints would have been more in keeping with her present day image.

You hit the SPOKES on his wheels, what sort of a car still has SPOKED wheels unless it is A/ old and sporty or B/ new and sporty.

 

Once had a friend who reversed into another vehicle in a car park. There were only two vehicles in the car park, hers parked at one end and the other car which was parked at the other end!

 

Jenny, is a practical 'Earth-Mother' type, small and cuddly with a bubbly and overflowing personality who needs the services of a large vehicle to contain her bubbly and overflowing personality as well as for carting everything and everyone around.

Of course you can the more the merrier.

 

I am trying so hard to imagine what car SQuareBob drives - but I just cant get this image out of my head of him running around in a fully fledged Clown car- complete with squirty water and flowers sticking out of it:confused: So I can not concentrate on a sensible answer

 

As I have now established he is a MOLE then it swings to an image of an old fashioned car from wind in the willows complete with a man with a flag walking in front of it.

 

I will have to keep thinking!:)

You are probably right - to get where I have in my job I have to be exactly that. Actually MOH chose the car for me - and as long as it gets me from A to B I am not too worried - and it is wonderfully reliable:D As long as you are not stalking me thats fine!

Ladees I prefer anything made during a period of greatness, the smell of Leather and Walnut, and the dull thunk of a car door closing does wonders for my ego. Unfortunately practicality steps in and I have to have a car that does not like going to the garage to be filled up and seems to go on forever, it only needs servicing when I remember to get it serviced, is reliable and can squeeze my two children, their friends and anything that needs to be moved in at any time of day or night, with the odd bump, scratch or two not giving me too many sleepless nights. The color is bright yellow and the mudguards are a nice shiny red!

If I were to really, really own and drive the car I wanted, then I would need the biggest and most secure garage in town and when on the road I would need at least a ten mile exclusion zone around the car. Passengers would not be permitted in the vehicle unless clad in a white boiler suit and secured tightly.

As I am unable to have the car of my desires, I will settle for a motorbike, nothing over the top, but must be 'sit up and beg' as my back would not take being bent over for long periods. I might have been able to achieve this dream had A&L coughed up, but looks as though I will have to wait a bit longer, by then I really will be the 'Oldest Rocker in Town'.

I have tried to post a picture of his greatness under my title or wherever, my son and daughter have also tried to no avail. Have asked Him upstairs how to post a picture, but no reply and no picture, so 'Clever Clogs' how did YOU do it.

Then go to user cp

then edit avatar

browse your folders, select pic and okay it.
