      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well it's only 5 months away!!!!! Can I suggest the city centre when the Frankfurt christmas market is open. People can do some shopping (german chocolate, cakes, jewellery - all sorts). It is likely details will be posted on the council's website closer to the date but this has been going on for approx 10 years and is always a winner in my household.

 

I would suggest meeting up in Bennetts PH, Bennetts Hill which is just a short walk from the train station up New Street.

Sounds good to me. The Frankfurt market is great. Have you had any other interest.

Hopefully all of my claims will have been paid by then.

Bennetts is actually a very good call.

 

a) it's near the city centre but off the beaten track

 

b) it's not on broad street

 

c) it used to be a bank! (i beleive)

 

d) it's not usually massively packed

 

e) it's only 4 miles for me to get home!

Do we want to make it a Saturday or a Friday? Howabout the middle of the month 14 or 15 December as the market usually starts the week prior so there will still be a lot of good things available. I am presuming evening and will people want a meal or just meet up for a drink as the food at the market is very good. I've heard Bennetts is good but I've never been and as it is near the station that is why I suggested it for ease of direction:) And there was me just thinking the ball would start rolling sometime in October. I'm handing an AQ in next week so will go to Bennetts and see what facilities they have.

How about Friday 14th (depending on Xmas market); start mid-afternoon through to the evening?

I think logistically, it is easier to meet up for a drink and take it from there.

60th Birthdays cannot be ignored. I don't mind if we make it a week later. There might even be a few bargains to be had as the market will be nearing the end. I will check on the closing date and post back. Maybe it was a good idea I started this thread so early...............

You just can't stay away from us!!!! (Happy holidays.)

 

I was thinking it was a bit close myself and it's never going to be possible to pick a date to suit everyone. Just checked my calendar and I am due to see Medaeval Babes at our cathedral on the Saturday so Friday the 7th? or the following Friday/Saturday will suit me. Which would people prefer - the Friday or the Saturday. I think it would be best to meet in front of the 'flussy in the jacussi' which is the local nickname for the expensive statue (with descending fountain) located in front of the council house at the top of New Street at say 18:00 - 19:00 with a projected move to Bennetts by 20:00. Or we could meet at Bennetts and then move to the market which closes at 22:00 if memory serves me right. This is right in the heart of the German Market with excellent food for meat eaters and vegetarians alike, and different alcoholic beverages within a few short steps (and at only 5' 2" they are short). How does that sound?

 

Just checked online and our market (which allegedly, with 75 stalls) is the biggest outside Frankfurt opens in November and ends each night at 20:00, so I propose meeting by the 'flussy' at time stated above.

Its a long way to travel, but im up for it!!

 

As long as some one can recomend some where decent to stay that is near to the meet.
