Barclays have submitted a defence and are saying that I did not submit all the claim particulars. Fine. I have my table of fees - where do I send these though? The Bank or the court? If the bank, which address? Local branch? As that is all I have used so far for correspondence about charges. Confused as the letetr states "All further communication should be addressed to.." then the addrss of the new court. I've tried calling them and get no response; constantly busy.

 

I just want to know if (a) it's ok to merely send them my table of charges and interest, or if there needs to be some official documentation. What about a covering letter? how should I word it? Also it does not mention on here how long I have to do this.

 

I just don't know what to do now really - who is waiting for whom? Should I expect things from them like a court date, etc?

 

Sorry for all the questions - getting quite frustrated trying to search dialogue about this particular issue though!

OK - will send my charges to the bank - with what covering letter? Just something along the lines of 'here are the charges you requested?'. Shouldn't this go to their solicitors though? (Who I haven't heard from yet).

 

RE sending to the court - I have used MCOL. Now I've received this from the court so the forms dno't apply to me (they're for starting a new claim...?).

 

What covering letetr do I use to send my charges info to them?

Sorry, I can't find these. All the links to covering letters here aren't relevant - they refer to sending the letetr to MCOL (I'm not doing this) or to bank's solicitors (I haven't been informed of this yet), or accompying the N1 form (I'm not using that).

 

I need a coevring letter to send to my bank, and a convering letter to send to the court, and a confirmation that I need to send this to the court if I have only yet had the "Notice of Transfer" - not the notice of proceedings.

As you have now filed ALL correspondence to the bank goes to the Litigations dept ........ just alter the address on the mcol 1 to that of your local court and sent the 2nd 1 to the litigations team addy that i posted above

What do you mean by "mcol 1"?

 

Why should I be sending forms to the court when they haven't requested them?

OK thanks - I've put that summary of charges into the post, to that address with a covering letter I write myself, I'm sure this will be fine.

 

Now, what do I send to the court, and why? It's not clear from this letter I've received - "Notice of Transfer" that it's yet time to send them anything. They have attached the bank's defence, but they don't explicitly refer to it. The only implication they want anything is that it says "all correspondence should nowe be addressed to.." then the address of the new court. But it doesn't say what. There's no alocation questionnaire.

 

If I do need to send these charges to the court as well, please can you give me a link to the post, or even betetr a direct link, to the covering letter I need to send with this, as I can't find the one I need in that thread - they all refer to different situations.n I don't want to send anything to MCOL as my claim isn't with them anymore.

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

My sincere apologies - things don't come over how they sound. I'm not being rude, I'm just trying to save some time as so far I haven't been able to use his references to things on the thread, so it will be very helpful to me if he could use the links to the actual posts.

 

Sorry if this comes over as ungrateful....I can't think of a much better way of wording it! Maybe I should get used to using the smiley things, they make a lot of difference.

 

In particular, am I right in thinking you've taken me to mean "it might help.." sarcastically, i.e. I meant "it would help a lot!"? It wasn't meant like that, I did actually mean verbatim, "it might help."

Very grateful for the details about the Bank Letter. Sent that now. Just need confirmation about what I need to do, if anything, about sending things to the court. Note there're no explicit instructions on the letter from the court. Am I right in thinking that so far, this is just notice of Transfer, as opposed to Allocation, and I'm waiting for more information to be sent?

 

I hope so - I have just been reading for hours on here about people sending items to the courts and I don't want to be sitting around twiddling thumbs when I'm supposed to be sending docs to them...

As far as I know (from reading around the forums) all you need to do at this point is to send your schedule of charges, marked with your case number and a covering letter asking for them to be attached to your case, to your local court, i.e the one you have just had your case transferred to.

 

From your previous posts you have just sent them to Barclays again as well. Yes?

 

I'm sure someone will correct me if I'm wrong but I don't think I am

sometimes it doesnt work that way, if we can refer you to a particular post we will, but remember we are only doing this to help you, we are only members who have also been through the process... this isnt our job,, at the very least, you are being directed to somewhere that may assist your claim.

Any advice offered by Saintly is also based on HER experience and I have yet to know of her giving poor advice.
