As posted earlier

It all depends on whether Barclays submit a late acknowledgement and have it accepted by the court ..... in which case the case will continue on the same path ..... OR Barclays ask for a set aside of the judgement which could delay your claim .... OR once you get the judgement by default Barclays will have to pay you . they will proberbly ask you to apply for a set aside of the judgement so that they dont have a ccj against them :-)

Hi Guy's just a quick update; I got my Judgment for Claimant letter in the post yesterday. So I called B's legal team today they have told me that a settlement letter has been sent out in the post, for what he thinks is the full amount. I think I have won :):) it all seems to easy. Can anything go wrong at this stage?

Anyone? just not sure it's nearly over with the help of this great site it just seems to have been too easy. I can't get my head round Barclay's not putting up a fight or stalling.

If and when you get the settlement offer

a) check the amount matches yours - if not cross it out, amend it ans initial.

b) cross out the confidentiality clause and initial it.

c) add at the bottom

Court action will be discontinued on when cleared funds are in the account of my choice

and guess what initial it

d) change the full and final settlement to

Full and Final settlement in connection with THIS claim

this allows you to claim again for new charges if necessary

e)if your letter goes into two pages, sign directly below the bottom line on both pages.

 

if youve ever had to sign a statement for the Police its basically the same, all alterations to be signed for.

 

DO NOT accept the offer unless you are happy to do so.

hi guy's, just a quick update, spoke to Dino from Barclay's legal team on Thursday after my offer of full payment. Explained to him that B's were about to close my account due to being over my overdraft limit. He said he would speak to someone and get it sorted. Called him back on Friday morning and he said that all money has been paid into my account. so off I went to cash point only for it to swallow my card (without getting balance)so queued up a counter not knowing what to think, but to my surprise the money had gone in on Thursday. So that's it I won, just wanted to wish everyone who is still waiting, the very best of luck!

 

PS; as soon as i get new bank card donation will be sent.:):):)
