Has anyone has any experience with regards to what I'd call 'hush money' from the banks (in particular with reference to overcharges by banks, credit card companies) to keep any result of your claim confidential. I know a sticking subject as I may be asking you to discuss something your not allowed too :confused:

 

If so how did it come about? Did they offer it, or did you ask? :-?

when they write offering to settle they put a confidentiality clause in the letter, saying that by accepting the amount you agree not to disclose to any third parties.

NatWest - Settled in full 22/05/06

£500 offer 27/05/06, rejected 30/05/06

Defence received 20/07/06

Settled in full 01/09/06 wahey!!!!!!!!!

As far as I know no-one's been offered a decent extra amount for staying quiet if that's what you're getting at. Some will of course accept a full refund with a confidentiality agreement because they don't want the hassle of going to court and they've got their money back which is what they wanted, which is fair enough.

 

Some on the other hand refuse the agreement and the banks often give them the settlement anyway.

 

It's your choice if it comes down to it.

In a nutshell, if you accept a confidentiality payment then don't sell your silence cheaply...but it is your decision whether to accept or not...:rolleyes:
