I would be careful about your letter of reply.

 

You wil not be able to impose any conditions which were not included in your original claim.

If you do they can withdraw their offer or worse they may merely go onto to court and show easliy that they have attempted to settle and that you have now needlessly incurred cost by enlarging the claim vexatiously.

 

Just accept the money and let it go.

 

If they cause you any other damage then make it a separate issue.

sort of. i also have a letter from the bbc offering to settle in a copyright suit :)

 

I had one of those once.

 

I took some video and a cheeky company which made a programme called "How did they do that?" tried to use some of it without my permission.

 

The cheque came in very handy :p

lol. i always have a minimum of three ongoing suits at any one time. the virtue of a popular website is companies steal your work. current ongoing action is against bbc, mardix, and uk metric association. next up is a steel company.

today i got a nice letter from them saying if i went and got another charge theyd close my account with 30 days notice. naturally i went in and beat them to it, also moved the business account which has never ever had a charge.

that one makes them at least 400 quid a year in foriegn banking fees alone! silly them... they should have been glad to make profit from me legally from things like overdraft interest when its used or the fact that my current account was three grand in credit earning them a nice little amount of interest, rather than no profit at all. also though, and more interestingly, it seems their threat to close my account conflicts with the out of court settlement they made with me. i now bank with the RBS.

No, RBS is the Royal Bank of Scotland - HBOS came about after the Halifax merged with the Bank of Scotland.

Request for Repayment sent 5th April £407

Offer of £238 received 21st April

Acceptance of offer but not as FFS & LBA sent 21st April

Papers taken to Sheriff Court 15th May - hearing set for 11th August

SETTLED 9TH JUNE £407 + £39 EXPENSES :)

 

Request for Repayment of charges sent to GE money (Monsoon) sent 28th April

LBA sent 12th May

Called GE Money who denied receiving any correspondence, cheque should be sent out in the next 7 days...

Cheque received 7th June

when i settled with them they said something along the lines of "we reserve the right to close your account if you sue us again." nice to get a letter that completely conflicts with this only a couple of weeks later, i would NEVER have accepted their settlement had they done this originally.

unfortunately for them theyve pissed me off, they owed me 28 quid in interest i didnt add to the claim and would have had to make a second one for. im now beginning legal action against them to reclaim this further 28 pounds. its not much but it will annoy them.

secondly, im making multiple complaints to the banking ombudsman about their complete lack of service in the past - how does one manage to input a minus instead of a plus into someone's account balance??? well the halifax managed. the ombudsman charges 700 quid a time to investigate so well done there halifax!

thirdly, im making a full data protection act request, im not just after statements ( i dont need those but ive requested anyway as the postage comes to more than the five quid they've charged ) but im after all manual input on the account including logic processes. im using this to back up my court claim.

finally, they very kindly sent me a nice pre paid envelope for something a few weeks ago, its now winging its way through the british postal system with a brick attached. just how many thousands of pounds has their stupidity cost them in trying to threaten me in lost profits, further legal action and additional costs they are now running up?
