the charges are £7955 for 52 months, i have added the 52 months together and divided it by 52 to get amonthly average then multiplied it be 8 and added it to the origional sum which comes to almost £9000 without interest (they didn't send me a full 6 yrs statements)

The biggest successful claim to my knowledge is over £34K. However the analysis of you arithmetic makes absolutely no sense. Can you explain why you have applied the multiple, with this size of claim you will need detailed analysis of factual charges, not a figure plucked from the ether.

i was only given 52 months statements from the bank instead of the requested 60. i was told by a colleague that i should estimate the charges for the missing 8 months by gaining the average monthly charge and mulyiply this amount by 8.... is this not right, i am about to complete the N1 form and was wondering if this was ok and how to put it down, should i just claim the 52 months????

OK I am with you now. As they have failed to fulfill the S.A.R - (Subject Access Request) then yes you are correct with you method of calculation. This will be a protracted claim because of the significant amount, but I am sure that ultimately you will be successful. Doubtless you realize that you willnot be able to use small claims route because of the amount, but this has certainly not been a factor in other cases. I hope you make swift progress, good luck with your claim.

i have decided to make my claim easier by not adding the estimated charges for the missing 8 months statements. can i ,make a seperate claim for the rest? will it make a difference if the amount i claim on the N1 is different from the 3 letters i have sent. i have completed a new schedule.... help i'm out of my depth!!

Ok that will be fine, the amount on your legal claim is the crucial amount and it will not matter that it is different from the amount in your previous correspondence.

:p ok, been to court and filed my claim for £9222.84. it cost me £250. i will be looking for more help when i get to the next stage but for now thank you all very much for getting me this far :D

In my opinion this is the wrong way to enter a serious claim and I would expect that Lloyds defence will point out that there is no basis for part of your claim.

 

A much better route would have been to have issued a claim for the charges that you have evidence that you have incurred and also taken action against them for their DPA non compliance.

No sit tight, there is alot of time when absolutely nothing happens. Have you asked the bank for your 't & cs', they should provide them, all part of the service.

 

It is a good policy to keep the bank personel on side, it is the Financial Megalith you have in your sights!

LTSB have until tomorrow to file a defence, and yesterday they put £750 in my account and i recieved the standard letter as this being full and final settlement... i have sent the templet letter accepting the sum as only part of the total and informed them i intend to proceed in court, do i wait for a letter from court or do i ring them tomorrow!!

i have contacted the court and lloyds tsb have put in a defence and they are sending me the AQ. how do i inform the court that the bank have paid £750 into my bank ? is there a templet letter?
