Northampton Bulk Clearing Centre refuse to believe Bryan Carter and Co doesn't exist anymore. When I asked them to ask the Law Society they said, "we shall ring and that will prove if they exist, thank you".

Just rang Bryan Carter Solicitor and they are STILL strading as Bryan Carter and Co. I asked for Crellins Carter solicitors and the guy didn't have a clue then suddenly said "oh yeah we merged with them, we are part of that company" So I asked if they were Crellins Carte Solicitors and her said "well we are Bryan Carter and Co solictors and we merged, do you understand merged, with them".

 

So I stated, "So you are not Crellins Carter Solicitors then?" and he said "well we merged with them." So I said "well I wanted to speak to Crellins Carter solicitors so if you are not them do you have a number for them?" and he said "We merged with them this is the number", so I replied, "But you are Bryan Carter and Co?" and he said "Yes", so I replied, "Sorry I need to speak with Crellins Carter and you just confirmed you are Bryan Carter & Co". Put the phone down.

Ask the OP for a copy of the Law Society letter they referred to in their posting & fax it to Northampton CC. Important as Bryan Carter appear to be still calling themselves Bryan Carter when dealing with telephone enquiries

Yes just spoke to the Law Society and they are on the case about this. If anyone wishes to phone up asking for Crellins Carter Solicitors and hears them say that they are Bryan Carter and Co then please do so and write to the Law Society stating what you heard and of course any letters after 28th Feb 2007 need to be copied and sent!

Not sure you should visit the Law Society website - just Goggle it.

 

Yes Fredrickson International are intrinsickly (sp) linked to dear old Bryan Carter.

 

Just phoned again and spoke to a "pleasent" (faints), young lady who told me even though my OH paid the CCJ on the 15th of the month, it was due on the 17th of the month and arrived on the 21st of the month. He paid it by electronic transfer - not 7 days to clear! Still she gave me the address to send my evidence to at Persimmon House in Weybridge - same address they had 2 years ago and they answer the phone as "Bryan Carter and Co".

 

Go on try it - ring them and ask for Crellin Carter, sound dumb, but they'll say they are Bryan Carter & Co.

Just spoken to the Law Society and they have said anyone who has a Bryan Carter and Co letter from after 28th Feb 2007, they would love a copy of it. Plus Mr Carter is now in a new firm which started on March 1st 2007 called

 

Crellins Carter

111 Queens Road,

Weybridge,

Surrey.

 

What's that film? Oh yeah - Get Carter! ;)

I wonder how many more DCAs are using headed notepaper from solicitors who the law society would be interested in.

Are you sure of your spelling should that not be Crettin Carter:wink:

And what month did you pay it to them,if after february the 28th wouldn't you be paying it to a company that no longer exists

Can you think of any grounds for appealling the CCJ. Any 'new evidence' come to light since CCJ was granted. As BC is no longer trading you may have overlooked something or discovered something they alleged was not true with the benefit of hindsight

Yeah I have evidence - it was paid within the month of the court judgement and thus should never have been on my file. I should never have had a CCJ. This is what I need to write to them with to get it overturned!

I sent 2X£1 postal order's to these for CCA on the 8th of may recorded delivery they have been signed for, so just a waiting game now to see if they are cashed:D

 

Where they made out to BC & if so they should have been returned to you with an explanation of why.

The law society has emailed me and stated that Mr Carter is entitled to persue any existing debts i.e CCJ debts even though the company has seized trading.

I have emailed them back asking if he is still entitled to cash my postal orders in regards to request for CCA'S which they received on the 9th may made out to Bryan Carter &Co they have not responded.

You know he is, he knows he is, the banks know he is and I bet the Law society will soon know it too. Doubtless your cheques/postal orders ar a/c payee only. I wonder if he has heard of the Cheques Act 1992
