Hi everyone

 

First post on here! I have been an avid reader for some time now!

 

I am really gratefull for all the usefull info on here.

 

Anyway I asked for my 6 years statements about 2 weeks ago via telephone banking. They arrived on Saturday 5th May. I have now written my prelim letter and calculated all the charges.

 

I will be sending this letter and charge calculation to NatWest via Recorded Delivery tomorrow am. Do I start the 14 days from tomorrow when i post it?

 

Claim totaling - £6,586.00 ex any interest.

 

I will keep you all posted how I get on!

Quick question to all you Natwest gurus!

 

I have a graduate loan wiht £4.5k still outstanding!

 

With my claim for £6.5k in charges are Natwest likely to give me 30 days notice and close my account? Will they call in the loan? Can they just call loans in?

 

Really my question is should I be opening a parachute account with another bank? If so who are the most likely to offer me an account with a bad credit history?

 

In last 6 years I have had a couple of CCJ's, defaults and loan / mortgage arrears all thanks to an ex screwing me over for everything! Basically my credit is shot to pieces hence I am really worried about actually being able to get another current account with someone!

 

Any advise gratefully recieved!

Hey. I posted the prelim letter off today by recorded delivery so I will start my 14 days as of tomorrow.

 

Should I also email the letter and charge sheet to customer.relations@natwest.com or just leave it?

 

After my 14 days if I have not recieved anything do I then write the LBA?

I know they sometimes call in overdrafts but I don't think they can with a loan as its like a seperate account and subject to contract. If they did, you would probably have a claim against them for breach of contract (perhaps you could charge them £28 LOL)

Hi All.

 

I posted my prelim letter off on the 8th May by recorded delivery so the 14 days they have to respond expires on Wednesday 23rd.

 

In advance of this date hould I also email the letter and charge sheet to customer.relations@natwest.com to give them a nudge or just leave it?

 

After the 14 days have expired and if I have not recieved anything do I then write the LBA immediately?

Hi chris,

 

Personally, I wouldn't bother emailing to nudge them - you'll probably only get a load of flannel off them anyway!!! They don't seem to be responding to many of us at prelim stage - most peeps are being completely ignored!

 

Don't let their silence deter you, once the 14 days are up, send the LBA with another 14 day deadline - recorded or special delivery again!

To be honest, I think they're just that snowed under with claims at the moment that they can't keep up with us!!!! Bless!!!

 

Stick to your timescales and don't be put off by the fact they've not responded. And if needs be, please be prepared to take this all the way to court as well. And above all.......... don't worry!!! There's loads of help and support on here - so you'll be fine!!! xxx :p

Just to check! The 14 days are up and I did not recieve any kind of reply from Natwest following my first letter!

 

I have read the FAQ's etc and the next step seems fairly simple!

 

Send my LBA letter with a schedule of charges attached as per my first letter! Again send by recorded delivery!

 

Anything I have missed?

So I prepared my LBA and got it in the post on Friday 25th!

 

Postman arrived on Sat 26th with a fob off reply from Natwest. 3 days after the 14 day time limit!

 

Dear Mr xxx,

 

Thankyou for your recent letter regarding the fees applied to your account.

 

We are currently considering your claim. Guven the work involved in assessing your claim we anticipate we will be in a position to respond within 6-7 weeks, but will endeavour to do so sooner if we are able to.

So now I guess I just sit and wait for another 14 days and see what they fob me off with this time!

Standard bog-off letter from nat west - not everyone gets them though..... so you're one of the chosen few!!!

 

It won't hurt to start getting your claim together. Have a look through here Getting MCOL Right to give you a helping hand. Personally, I'd start the process not long after the LBA deadline if you haven't heard anything!

I am a little unsure the best way to do this. All indications are that filing an N1 with the local court is far better than doing it online! Am I right?

 

Also when I fill in the N1 would I be able to add any charges I have incurred since the original calculation and any interest up to that date?

 

If so how do I word this or do I simply ammend my spreadsheet? This would then show a different figure to all me letters!

MCOL v N1

 

Guys I am nearly at the next stage ie to submit a MCOL or N1.

 

I have read as much as possible on this site but still can't understand which is the best route to take?

 

I really just want to go down the fastest possible route and it appears that MCOL only adds time to the process. Is this correct?

 

Who has done what and wiht what sucess?

I've only used N1. MCOL is convenient in that you can do it online. However, the space for your PoC is limited and that can lead to extra communication with Cobbetts and then MCOL have to move it to your local court. My perception is that the N1 route looks quicker butits hard to compare. The only way would be to file the same claim both ways - but I expect that HMCS would take a dim view of that!

Apart from the N1 form and schedule of my charges (inc Interest this time) is that all I need.

 

Can someone remind me what I would need to pay the court for the fees and is this done upfront?

I don'th tink you actually need to take it in person. I think you can send it by post too. However, my local court is about 10 days behind opening the post at the moment so, if you can take it by hand, it is probably better.

 

You only need to send 2 copies - one for the defendant and one for the court. If you take a 3rd they will put the claim number on and stamp it for you as your copy. I left it with them but apparently they will do it while you wait

I am just finishing my N1 as today the 14days are up since my LBA and I plan on making a trip doen to my local county court tomorrow morning!

 

Before I make a mistake on this can you guys just check I have the correct details (as below) on my N1 :-

Value

 

Charges £ 6,728.00

Interest under s.69 County Courts Act 1984 £ 1,213.47

Court Fee £ 250.00

 

TOTAL £ 8,191.47

 

Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £1.48 per day OR at such rate and for such periods as the court deems just.

 

(Did I work this £1.48 bit out right? I really don't get what this bit is all about?)
