I've seen the same as you, no clear guidance on it so I'm going for it anyways. I'll keep you posted when I hear something back.

thanks I had advised my son to claim the interest ( if applicable ) but wasnt sure if that was the right thing to do, so now I will wait to see what happens with you.

Received an Acknowledgement from FOS today confirming receipt of my complaint and stating someone from customer contact division would be in touch with a detail response within 14 days. Also gave me a reference number for my complaint.

I don't have a letter that says "final offer" on it. They haven't made any offers actually just told me to go away basically. however, my understanding is that FOS will deal with when you EITHER have a final offer or if the bank's 8 weeks have expired which they have by far for HBOS.

 

I do have a letter from HBOS telling me to p*** off and if I don't like it to complain to FOS so I took their advice ;)

was just asking as I sent my sons offer for the A/L to the F.O.S said they would be in touch in 14 days got a letter this morning with their form saying this is not a final offer, that the last paragraph should say about contacting the F.O.S. so me returning their form and the offer has been a waste of 14 days

not really because A/L wouldn't have moved any faster anyways. So hold onto the form, write back to A/L telling them to get their finger out and when the letter does come through resend the FOS document.

actually it was the right amount they offered he lost his job and there was no money going in to the account so they closed it. I was just wanting it cleared, which they did and money back so I was happy. Sent acceptence this morning. Got the same problem with the R.B.S not heard a thing from them so we will see how it goes. Thanks anyway

Just thought i'd let you know I received the same letter about 2-3 weeks ago, but yesterday i phoned the FOS regarding a letter i got from the bank, the guy told me that I should expect an offer from the bank in about three weeks as this seems to be the norm once the FOS have sent them their letter requesting any files. I said, really! and he said quite confidently 'Oh! you'll get an offer"

 

Just thought I'd let you know.

received a letter from the bank (at last!) saying their final response was they are declining my request and they feel that their charges are fair. They inclosed a "leaflet" which was a really crappy photocopy. Nice to see the effort they put in to dealing with customers! Anyways, letter doesn't matter since I've already taken it up with FOS.

 

Received a letter from FOS this morning updating me on their progress, stating that the banks position is they disagree and as such they are requesting a number of bits of information from them including how charges are calculated, how they constitute a reasonable pre-estimate of the banks costs, any credit risk costs etc etc. Apparently I will hear from them again within one month to update me on progress.

I am at excactly the same stage. Got that letter a couple of days ago. I'm claiming £4600. All the waiting is a pain but will be more than worth it.:)

I'm at the same stage.

 

Got a letter form A&L offering me a piddley £1553 when I'm claiming for £6831. Refused their generous :rolleyes: offer and got a final letter from A&L saying I'd have to take it to FOS if I wasn't happy. All info has been sent to FOS so i now await an outcome. Fingers crossed!!

I was checking through your thread to see what the time-scale was for hearing from the Information Commissioner's Office.

 

I submitted an initial complaints form at the beginning of June - followed by a letter (12th June) enclosing additional information - and haven't heard a *PEEP* from them, at all.

Found this link, someone else had posted in a thread I am subscribed to:

 

Bank Charges: Reclaim them, they're unlawful, get up to six years' money back...

 

Says FOS is currently taking 2-3 months to deal with complaints. Almost 2 months gone, so hopefully sometime in the next 4-6 weeks I'll hear something.

 

So the FOS route could take up to six months from initial complaint (including the initial 8 week period) but the good thing about FOS is you can complain more than once about the same bank I would imagine unlike court. Think I'll request credit card statements now.

Received a letter from FOS today stating that BOS think there is nothing wrong with their charges but without admitting liability they would prefer to offer me £2993.82 as full and final settlement rather than having a formal FOS investigation so I've written to them telling them to stick it since it doesn't include interest nor do they mention removal of the default. Nice to see the offer come in, getting close :D

 

FOS is much better than going to court especially if you live in Scotland. So far I'd recommend it to anyone!

Apperently we have a letter from the FOS today asking if we wish to proceed as the RBOS have deposited £2460 into our account (minus interest).

This is odd as the RBOS left us with the offer and to fill in the usual acceptance as final forms which we forwarded to the FOS last Friday along with a charges schedule listing interest. We have given them no answer and we have checked the accounts left with RBOS and - no money.

 

A bit confused.
