Sold Kays Debt being transferred constantly

In June 06 I began a debt management plan with CCCS.

I so wish I had contacted them 7 yrs ago rather than re-mortgage 3 times but that's another story!

 

One of my creditors was Kays catalogue.

Kays were the only ones to accept reduced payment straight away without argument.

However, they have sold the debt on

 

the last 4 months I have been constantly harassed by 4 different creditors.

I pay CCCS on 1st when I get paid and they send payments to creditors on 25th.

 

Each month I have had a letter from new creditor (no correspondence from previous one) saying I have to pay them in future.

I alter details with CCCS but each time the previous creditor has just been paid.

 

I receive phone calls each day, often many times in one day, asking for a payment.

I say i have already paid previous creditor but they insist I pay them or they will take further action.

As soon as they receive a payment I get a letter from another creditor and so it goes on.

 

The latest one is intrum justitia and they are saying if I do not make a payment in next 7 days they will start court action.

 

I have never missed a payment to CCCS -any suggestions for stopping this constant harassment??

dee, send them the CCA letter by recorded delivery, with £1 PO.

 

See what they provide and then post back, yes?!

Relax Dee, I'm sure someone will come along and help.

 

I'm new here and can't really give advice but I know you need not be harassed by these leaches from what I have learnt.

 

Firstly, these bloodsuckers can be stopped in their tracks.

 

This is all I can say right now as I don't want to send you down the wrong road. But you are among friends here and they will all help you over the next few days.

 

I just wanted to reply as nobody had yet but somebody will!!

i would also put in the letter two things:

1. the enclosed £1 is not to be used against my outstanding debt.

2. if i do not hear from you by [12 days] from the date of this letter, i will cease all payment until you provide me with the requirements of my request under the CCA act 1974. This also prevents you from selling on my debt as it is now in dispute.

do it yourself.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

When I made offers myself to creditors most refused and threatened court action unless I went through CAB or someone like CCCS.

It's also simpler paying one SO to CCCS than sending off lots of cheques for small amounts.

I have now sold my house and moving shortly to a HA property which will hopefully allow me to pay off most, if not all,of my debt plus the rent is over £300 a month cheaper than my mortgage payment. I have struggled for years to pay my mortgage believing I had to own my home but just want my life back and not have to constantly struggle just to keep my head above water.

As I said in a previous post when I've gone to HSBC in the past for help with debt I have ended up consolidating my debt by re-mortgaging 3 times and twice they gave me a loan to consolidate the debt I had with them. In fact when I offered them reduced payments before going to CCCS they said they would not accept reduced payments but offered me a further loan even though my budget sheet I provided stated quite clearly I could not afford the monthly payment - it was more than the total amount I had available! If only I'd had access to you wonderful people then eh?

 

I am reclaiming my bank charges from HSBC - they entered a defence Thursday - day before the 28 days were up.

Anyway, back to my original post I am off to post my letter to intrum justitia.Thanks for your help.
