Having successfully knobbled Abbey, I have started preliminary skirmishes with barclaycard.So far I've requested a full schedule of charges for the last six years under the DPA and that they are required for a possible coutrt case.I have informed them this can only be charged a tenner for.I have also outlined my case as far as the charges are in my view not reflective of the damages to the bank by my breach of contract and therefore constitute a penalty making them unenforceable.They have repiled firstly saying that they do not agree with my legal analysis and that secondly they can only provide a schedule of charges for the last six months , any further statements will be charged at 3.00 per sheet. How can I force them to give me details of my charges and has anyone been down this road with barclaycard already?

Subject Access Request.

 

request all information that come under the DPA to be sent to you.

 

no ifs no buts, the whole lot.

 

If its on a computer and it concerns you, you want it.

 

You should somwhere in the mist of it all have a record of all charges levied on you account. Other than that, pay 3 quid a sheet and make them buy them back once they want to settle out of court.

 

Best bet otherwise is to go for an unknown amount, go for no more than 4k or somthing, one can assume they will soon dig up what they owe in stead of going to court.

Corretc. Use the DPA request letter in the library. Amend it to include a protest and that the clock is till ticking.

Also remind them that they have a fiduciary relationship with you and by attempting to mislead you as to your rights inder the DPA they are breaching this duty and that this is a serious matter.

has anyone been down this road with barclaycard already?

 

Said they same to me yesterday, the operative was insistent. So i just said fair enough, ill add it to my bill. speak to you in a few days!

 

Not as bad as Goldfish though. These guys want five pounds a statement, they got the DPA letter sent today.
