  13. Are both images now showing? So in this case does the default drop off and the account remain on file with further activity or the account in its entirety drop off from the date of original default?
  14. Thanks Brigadier, i appreciate this! Its 1st Credit, as hopefully per the pictures below, they have actually logged this twice on my CR as two seperate accounts, one is the full amount of the loan, the other is the reduced amount after i paid a degree off, but its reported as two totally seperate debts, with multiple defaults. Ive tried writing to them several years ago but was stonewalled, They hounded me for a while with the usual tactics until i arranged a payment plan. They couldnt provide any proof of a credit agreement nor that they indeed owned the debt, i raised it with equifax and equifax insisted that the onus was on me to prove it didnt belong there with 1st Credit stating it belonged to me and both listings were in order. I gave up after toing and froing and just thought it was better to wait for the six years to expire but am not sure where to go from here, have been scraping together what i can for a house deposit but feel this will scupper it so anything you can offer would be welcomed, thank you in advance! I have a defaulted account with original date of default listed as Jun 2007, in theory i was expecting this entire account to then drop off my file in the next couple of months, i have just however checked on Noodle in more detail on the account history and twice following the original default i subsequently made arrangements to pay which appear as a series of AP marks on my file. There is then a further default notice on the same file. My question is will the entire account come off or will just the original default drop off and the remaining APs and additional default remain? It seems bizarre i may have to wait a further 2 years for it to come off, anyone with experience or insight into this it would be appreciated, i have read through the forums but havent come across any threads where a default was followed by APss and a further default. thank you in advance!

Hi, I have a default notice dated 2007 on my experian file from 1st Credit, i have never entered into any formal agreement with 1st credit though i did make several payments to them under duress before i was properly armed with the facts from here with regards to them being able to provide written proof that i had a debt with them, As they were unable to provide this upon written request they ceased to harrass me, however since i have never actually had a loan with them am i within my rights to challenge the default entry and if so how would i go about this, contacting them or the credit agency or both? Any pointers on this would be really appreciated, its the last blemish on my credit history having dug my way out of a lot of debt and all thanks to the advice and help on here on here, thankyou guys!

Hi, I am currently not on the electoral roll despite having lived at my current address for sometime, i currently have a satisfactory credit rating on experian, 767, however i want to improve it as have now cleared the majoirty of my debts and want to start afresh, so i could look at getting a mobile phone contract so really need to get on the electoral roll. However, i have a default on my credit file, this was logged in Aug 2007, it was passed to a well known DCA who for a while pursued me but have in the last year or so given up, i asked them repeatedly to produce a document that proved that a) the debt was mine and b) they now owned the debt, they were unable to do so as expected and now i just the get occasional phone calls but just deny all knowledge etc, so, if i go on the electoral roll is it likely this will impact on their activity, they already know where i am, have sent me stuff in post and landline etc as ive said, which to be honest im not too bothered about as i enjoy talking to the b@stards and taking the p_ss out of the phone monkeys that used to give me so much anguish and sleepless nights before i found this forum, so i can handle that, but more importantly i guess is will it give them a handle to pursue me in court or take any further concrete action? Any Advice is much appreciated! Thanks

I currently have two outstanding accounts, both with one DCA, they have just exceeded the CCA request on one account and have sent failure to provide letter the other day, the debt is over six years old and doesnt show on my credit report so not overly worried. However, i know there is a lot of charges on this account, circa 1k, if i wanted to recover this, is it feasible still having got this stage and do i tackle the DCA or the orignal lender? Would doing so possibly provide either with significant reason to dig deeper to find my cca though, has this happened to anyone? Also, for the second account,the debt is four years old and was defaulted by the dca last year, if they fail to provide cca on this i understand they can take no further action but would the account on my file have to be amended to settled or would it still appear as in default? Apologies if i should have maybe split into two sep threads but as all generic procedural questions related to one matter thought would save time and thankyou everyone on here for support thus far!
  19. thanks for that guys, so, if they fail to produce the cca they will not be able to chase me for it i understand, and it will not appear on my credit file again as its over 6 years since original default and whilst i may be morally obliged to pay the debt back and it will still exist, to all intents and purposes there will be no evidence of it? am i right in thinking that or blinkered?
  20. yes unfort was making payments for last 10 months, ridiculous really, it was only last month i was made redundant from a banking recruitment job and couldnt pay so canx the direct debit, subsequently recieved some really ****ty phone calls, double figures in a fortnight, and then unbelievably caved into some phone monkey to start payments of 90 per month again out of my jobseekers allowance in the belief it wasnt worth the hassle. i put the phone down, shook my head and remembered i was one of the first onboard here and the good advice several years ago so came back, and felt better immediately. am actually really looking forwards to next call, hopefully the next day after they dont recover my re instated direct debit. anyhow, forgoing my stupidity in beginning repayments, is it feasible for them to reinstate the default in any capacity? it isnt listed at all on my credit file, either by them or the original creditor. many thanks again guys!

I checked my credit report today and it transpires that an account i was told was settled with barclaycard last year appears as nil payments for the last six months, but also says no balance outstanding and no payments due but obviously it is an adverse mark on my not fantastic credit rating.. whats the best way to approach them to get this sorted out, do i send a template letter or a general complaint or speak with a regulatory body? any advice much appreciated! incidentally the account was settled after they swiped half my wage from barclays current account one month to pay off a defaulted card so i complained bitterly, they refunded the whole amount and settled the entire debt. edit

Hi, I have recently been getting harassed by a dca for an outstanding debt from an old credit, 1st credit oh joy, anyway i have sent a cca request and am awaiting a response non response and subsequent bombardment of telephone calls when the time limit expires and i canx the direct debit. Anyway today i checked my credit report, and the debt does not appear on it in any form, i believe the original default was in 2002 or 2003, subseqently it has been passed around and ended up with 1st credit. Im assuming that the default has appeared in the past but has now been scratched as it has been over six years, my question is would 1st credit be able to enter a new default regarding this debt in any circumstances? many thanks!
  23. not sure why you would think that really? 3 or 4 days elapsed between the payment being processed and the warrant being sent to be checked before it was then issued so i would have thought this was the period when it would be possible for it to be set aside, once the warrant is sent to a local bailiff, thats it surely, its sent and will be executed?? On the PDF file it now states the banks head office as the place where the warrant will be executed rather the than the po box all correspondance has previously been sent to, my friend nor i have given those details to them. i hope you are wrong obviously but puzzled as to why you would doubt MCOL or do you have examples of it being inaccurate?
