I have a contract with Lloyds TSB Bank PLC, conducted on their standard terms and conditions. I am claiming return of money taken by the defendant in the way of charges over the last 4 years, totaling £2225. The charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have repeatedly asked the bank to justify their charges but they have declined to do so. I claim interest under section 69 of the county court act 1984 at the rate of 8% a year from (01/07/2002) to (22/05/2006) of £328.11 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 8%. I therefore claim a total of £2553.11 (£2225 + £328.11 interest).

 

If, as you say, you just put your account number, "claim for unlawful bank charges" and the 'interest bit' I'm not entirely surprised you got the response you did. Please, please, be careful when making your claim.

here goes after reading reloads i 2 am not surprised by the response from their solicitors:::

The claimant claims interest under section

69 of the County Courts Act 1984 at the

rate of 8% a year from {date when the money

became owed to you} to {the date you are

issuing the claim} of £ {put the amount}

and also interest at the same rate up to

the date of judgment or earlier payment at

a daily rate of {enter the daily rate of

interest}.

Looks fine wp - sorry if I came across a bit short in my last reply, but you really MUST be careful when filing a Moneyclaim - and generally speaking, by all means follow the guides and letters laid out on this forum but remember to pay attention!

 

As for the Particulars of Claim though, there is a draft copy in the templates library - which is pretty much exactly what mine is. You really should have spotted that ;)
