  3. thanks,luckily shes has since found employment with better pay,so hopefully everthing (fingers crossed)will be back to normal
  4. my wife has just been made redundant as there wasnt enough work to go round ,shes been there 10 months,she was sat down told she was been made redundant and that she would be paid until 31 dec 2008. she then got them to send her a letter confirming this,in which they say her employment is terminated 31 dec,theres no explanation just yr contract is been terminated. shouldnt they at least say the position is redundant so she can start to claim benefits etc,this just makes it sound like she has been fired(for no reason)

  6. sent a S A R for my docs over the last 6 years ,guess what recieved my docs plus a womens from bristol as well,all her bank details ,loan agreements,etc...oh what to do,i contacted them and they swiftly sent a sae to send back to them
  7. forgive me if this has been covered before. my bill date for a tesco credit card is the 30th of each month. I get paid every 28 days so i generally pay it early. I paid on the 5th december for the 30th decembers bill therefore paying 25 days early,only to be whacked with a £12 late payment fee in january 2008. when i queried this i was told that because I paid it on or before the 5th of the month(the day they send out the bill) It counts towards novembers bill ,effectively paying twice in november.surely if the due date is the 30th of the month anything i pay after that should be counted towards the next bill. now i have to re-budget to pay off januarys bill as i did the same again. I got the £12 back but i think this is a tactic to hit u with late payment fees. hope it makes sense (from the 30th to the 5th is no mans land)

    well i decided to complain to the information commisioner in the end..after a couple of phone calls i eventually got my statements..i`ll keep u posted on the out come
  9. if they charged u ,claim it back it does`nt matter if it was your fault. natwest took £260 one month off me due to charges .it nearly ruined me..had to take out a consolitation loan(not theirs although they tried at 35% apr)this is about the amount they charge not the circumstrance
  10. natwest cashed my cheque for £10 in sepember (origanally asked for statements in july) and still nothing has arrived.spoke to numerous people who said they would ring back,got a case ongoing with information commisioner(nothin heard) suppose court is likely.

  12. having requested info back in july 2006,i still havent recievied my statements through.i sent a cheque in aug (which they have cashed).i sent a complaint to the info commission(nothing recievied or heard),i wrote a letter saying i would start court proceedings if i didnt recieve my statements(hand deliverd),and still nothing. when i go to money claim wat do i put in the box regarding getting my statements,and will i be able to get the £35 it will probabllly cost me back,any help would be appreciated .
  13. just recieved my dpa request back and the sent me a print out of there computer which clearly shows the "system" automaticaly added the charges 4 late payment/excess over ect. has anyone else had this?

  16. here goes a little cheeky i know but it is worded so well thought it would be a shame to change it........ I have a contract with Lloyds TSB Bank PLC, conducted on their standard terms and conditions. I am claiming return of money taken by the defendant in the way of charges over the last 6 years, totaling £400. The charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have repeatedly asked the bank to justify their charges but they have declined to do so. I claim interest under section 69 of the county court act 1984 at the rate of 8% a year from (30/05/2000) to (01/09/2006) of £120.25 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 8%.   18. here goes after reading reloads i 2 am not surprised by the response from their solicitors::: request for unlawful bank charges to be returned. sent two letters requesting but refused . ref with lloyds BHAM/DJ/CC/878893 The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}.

  21. i will get it off money claim but i think if i remember rightly i did`nt put 2 much details only my acc number and claim for unlawful bank charges, also pasted and copied the interest bit you have 2 put in ---i will try to get it to show you... plus how do i rectify it
  22. here goes with the letter .... dear sir yourself v lloyds tsb we are in receipt of your claim against our client lloyds tsb.we suggest you re-read the particulars of claim.you have clearly used a precedent without inserting the correct information,and the particulars of claim are incomprehensible.we enclose a copy of our letter to the court on this issue. we invite you,within the next 7 days to : 1.provide us with full details of the account reffered. 2.give details of the charges claimed,specifying each and every charge and when debited:and 3 full details of the interest claimed,with dates and amounts. in the event that you do not provide these, we will ask the court to strike out your claim. to preserve our clients position,however we have filed a defence without prejudice to our intention that your claim is an abuse and a copy of that defence is attached. yours martineau johnson they then attach a copy which reads we act for the defendant in this matter and enclose our clients defence.a copy id being sent to the claiment.we have filed this defence without prejidice to the defendant`s right to strike out this claim which is frankly incomprehensible.the claiment has clearly used a precedent ,but has failed to complete any relevent information.we refer this matter to the court and ask taht this claim be considered an abuse ,pursuant to cpr 3.4.we have written to the claiment today to sak for full particulars , and in the absence of thes we beleive tha claiment should be struck out.the defence is filed without prejudice this contention. so what next
