Hi guys,

 

completely new to the world of claiming bank charges back, after some friendly advise if poss.

 

First came across the BBC report on all this a couple of weeks ago, and immediately downloaded the 6 months statements estimated figure letter, estimated £4800 based on 6 months of online statements and sent it off.

 

I have now received a response from the NatWest (took only a week) saying they believe all their charges are justified and in line with law etc... however we have ordered a copy of all previous statements free of charge (Result!) please highlight any charges you wish to dispute and return them, we will then investigate further. I have today, received my statements (140 pages worth :-| )

 

My question is simple, should i do this??? or should i now go straight to filing my claim at the court as they are taking the stance that they owe me nothing.

 

Am so glad i came accross this site, the BBC one made it sound oh so simple and probably would have ended up making me balls up my claim!

 

Looking forward to chatting to you guys over the coming months!

 

ps. im also into capitol one for £1400, the day i sent them my letter i also received one saying you have now defaulted and account closed etc, you owe us £1300, made me chuckle! :D

just added up total charges on statements, £4734.46 since the account was opened in August 2004. (Bloody good estimate at £4800 hehe)

 

Question: I get a charge at the end of every month which incorporates the fee for having an advantage gold account, and an unauthorised overgraught fee. as the charge for having an advantage gold account has changed a few times over the years, do i risk spoiling my claim by guessing how much to detract from the total charge? or should i just bang the lot in and let natwest dispute the adv. gold figure???

You can't claim for the adv gold fee as this would have been agreed by yourself for the service. Read through the thread NATTIE has pointed out and it will help you to determine the fee increases and work out what you can't claim.

just want to double check,

 

i see all over the site that charges refer to returned direct debits, cheques and standing orders.

 

Am i right in assuming i'm also entitled to claim for card misuse charges? these constitute the majority of my claim!

Yes you can, the only things you can't claim are adv gold fees and atm fees.

excellent, feel quite lucky that i got my statements out of them so fast, didnt even use your data protection act letter as i hadn't found this site by then.

 

Prelim letter going out tonight :)

 

Lovely of Natwest to look after my money for me all of this time! hehe

OK i've filled out simple statutory form, comes to £4280.00 (found some duplicates in the statements they sent me) or £4603.11 with 8%

 

I need to now delete all references to interest to send with prelim letter, is that correct??

well, its all go now :)

 

confirmation off royalmail.com that prelim natwest delivered (£4200) and SAR for cap one and halifax also delivered.

Update: I WON!!!!!!!!!!!!!!!!!!!!!!!!!!

full and final settlement offer of £4175 before i even sent my LBA!!!

 

thanks alot guys i couldnt have done it without this site, even though i only sent 1 letter im ready to take on cap one and halifax now!

 

will be sure to donate when i get my wad!
