good luck davy and hang in there m8. i too was receiving alot of letters/phone calls asking me to repay.... with what i ask - although it is my debt.

 

all sorted now but still waiting on bank charges from ft - case will FO so will not hear anything for donkeys now that oft are setting up a test case

Well, Came home from work today to find a letter from the First Trust making me aware of our small claims date.

 

They have basically told me that they are asking the court to hold off on the date until this "test case" is over. This was a bit of a sickner.

 

Does anyone know when this text case is due to be held?

No, you wont loose your court fee, it means you will be first in the queue when the test case is settled in our favour, with another two years interest in your pocket!

Just got this info on an email from moneysupermarket newsletter:

 

Millions of people hoping to claim back the sky-high charges levied on their current account overdrafts have been left in limbo by a decision from the big UK banks to jointly mount a legal test case that will finally decide whether they are legal.

The court case has been agreed with the Office of Fair Trading, a financial watchdog which is currently investigating this issue. The hope is that the matter can be clarified once and for all. If the court rules in favour of bank customers, everyone will be entitled to compensation – or not, if the case goes against them.

But the test case also leaves many people, who have already sent letters claiming back what they believe to be excessive charges, in a spot. In effect, unless they have already agreed a payment with their bank, they will have to wait until the outcome of the court case.

And what of all those who have been considering making a claim but have not yet done so? Should they just hang fire and wait until the case is heard?

My strong advice is to file your claim. In other words, download the various claim letters, do your sums and work out how much you may be owed and write to your bank making that claim.

There are two key reasons why you should do this. The first is that any claims can only be backdated by six years. So if you are forced to wait for a year or longer until the legal case is heard, you may miss out on that element of any claim you wanted to make.

Second, it does no harm to “register” your claim with your bank. It will have to acknowledge the claim and you therefore join a “queue” for payment once the court has made a decision either way.

Got confirmation from the courts that the cases are on hold until after the test case in England comes round.

i check this site most days.

 

the situation is no further on - we are waiting on judgement bein made so the claims sill sittin waiting

 

first trust still applying charges tho amongst other customer unfriendly gestures

Still waiting on word of when the courts will be open for this. Very frustrating.

 

The first trust took me to court over my bank account and a credit card account. Both totals together amounted to £200 more than my claim against them. Ive ended up with a CCJ even though I told them I will give them the £200 and call it quits. So now im even more determined to get them!!
