  1. hi guys, got a reply from FO, the say that the banks offer is in line with correct procedures and that i have misunderstood. The offer is in relation to the special hardship complaint that i made so my original request including interest still stands and they will advise the bank to keep record of my original complaint awaiting the results from the OFT case. Great news for us all I think as they have given me a partial offer indicating that they are gettin ready to pay us all out!!!! GOOD LUCK TO YOU ALL, FINGERS CROSSED
  2. ok, it becomes statute barred after six years, even if i request cca's or does this start the clock ticking again and if it is statute barred does it stay on the credit file as a default? thanks for the great advice
  3. ok , so basically you guys advising me to to get CCAs. And will it do anygood for the overdraft. I have read the threads on CCA's, is there a poss that the creditors no there ccas are enforceeable and this the reason why they havent taken further action. I will start CCA action this week, but i just baffled why they havent went any further, especially Ulster bank - 3 yrs after closin the account. Does this debt disappear after a certain time? Do i actually have to pay and what happens if i dont.
  4. No reply from bank as of yet, received a letter from FO advising about the off er of £2200 offer and asking if i accepted the offer as full and final. I advised them that i had since written to the bank advising that the FSA waiver states that they cannot give partial offers as full and final settlement and that i still wanted the rest including the interest. My original claim is with the FO (case pending) since the OFT case, just like many of your cases so i think thats why the FO wrote to me so they could close there case, so therefore my case is still running with them.
  5. well the overdraft is for 4500 but they closed the account down 3yr ago amd have referred the debit onto a few dif companies, i just wonderin how far they go with this and wh they havent brought it to court As for the credit companies, RBOS are owed 1800 and they have been ringing for about 6 months now, i havent paid them in that time and cant really afford to.

Hi guys, I owe money to rbos (£2000++), I cancelled my direct debit a while ago, the have defaulted the account, they ring everyday, i do not answer them as i see who is calling on the caller display. This have been going on for over 6 months now, what happens next and do i actually have to pay them, if i dont what is the outcome. On the account there was an insurance of about £15 per month. Can i claim this back and if so how do i do that? I owe money to the ulster bank for an overdraft. I dont remember signing anything to get the overdraft , just a phone call. I total about £4500. I have not paid anything to this account in about 3 years, the closed the account down about 2 years ago and have referred the debt to numerous debt collectors. I have had letters from each debt collector advising that the would have to do door collections within 2 days if i did not pay. I ignored these letters. As of yet, the case has not been sent to court. What path do cases like this normally take. Is it viable that the have not referred the case to court as there is no CCA? I appreciate your expereince on these cases. thanks
  7. i have a rew different outstanding credit card loans, overdraft etc - havent paid anything towards them in a while, one of them with the bank is three years old now, they have passed these debts onto to different credit agencies and i have received letters saying they goin to visit, i have just ignored everything, one of the debts have been passed threw 3 different credit agencies, where will this will all go in the end? any ideas?
  8. thankyou very much - i appreciate this, i going to go back to bank a tell them i want the rest now, the y have admitted that the should have set up and overdraft - i had 5 direct debit which where all below £2, i had insufficent credit in my account to pay - the charged me £38 for each of the dd's on same day - 5*38 - and 2 days later they did it again! thanks for this great advice
  9. thats what i am asking charlotte, what rights do we have for telling banks they cannot make a full and final settlement, so i'll watch out for a reply to your question, good luck with your claim, its hard to turn down money your offered from banks nowadays especially. this site is brilliant though and should set us on the right path
  10. when you say they arent allowed to do so, why are they not. I was made an offer of 40% of my fees, which i accepted. What wording can i use to advise them that they are not allowed to make an offer as full and final settlement?
  11. ok, i got 40% of the fees (donation to CAG sent - thanks thus for, i would never have anything about this only for this site and the great people within it giving advice) , my original claim included the interest, now that i have got something out of them, anyone any ideas how to word the next request thanking for the partial settlement and asking for the rest including interest? i would like to word it in a way that i assumed the first payment was partial settlement. Keep at it you guys, hopefully you get as lucky as i did
  12. hi guys, my thread Madjj v first trust bank is basically asking the same question. I have just settled for 40% of the balance. I have asked bankfodder if he has any advice on how to word a letter to get the rest. So i ll keep my eye on this thread also
  13. The questionairre was an expenditure form to ascertain my finanacial status - basically asking whats comin in to the household and whats going out. Bank Fodder - i have accepted the payment and waiting for it to be processed now. I just asking if anyone has accepted the partial settlement and then got the rest afterwards? Tnanks for your help
  14. Hi guys, i have tried to reclaim charges from FTB - my claim is in from just before the OFT case show it has been on hold, like most of yours for quite a while. The claim was for about 6,000. I completed a special hardship questionaiire sent to me by the bank, they sent it to me because i started a new claim for £700 and told them i was desperate. They have told me the from Nov 2000 to Nov 2008 i have been charded £5400 in charges, the have just made me an offer for 2200 saying that although the deem the charges to be fair, an overdraft should have been in place, ive accepted the offer, in todays climate who can risk refusing £2000. Any suggestions on how to get the rest? I open to all sorts of advice but not going to take any action until i get to offer. :twisted:

  16. never thought about that before - about them having our signatures on the cheque - good thinking i have asked for my cca - the case which referred to DEBITAS who going to take me to court. When i denied i owed the money and asked for the CCA - they have asked for the letter i sent requesting needs a signature. WIth advice from this site, i sent another letter with a signature i will recognise if the use it....hopefully they will so - i agree with the advice above - get someone else to write the cheque.
  17. they're unbeleivable arent they - ok i'll make a completely differnt signature and photocopy it - and if its the same one when they send the CCA ill let u all know - u can then advise what i do next.... i really hope they do that ..........hehehehehehehhe

  19. guys - have a post on this and you guys told me that when i get a reply from capital one to let you know what they said they have comeback to me and thanked for for asking for the cca but as i hadnt signed my letter they need a signed letter requesting this anybody any idea what this is all about the have past the debt to debitas, is they some hidden agenda behind them askin for this? help
  20. thanks for your help mate - they havent replied and its more than 12 days now since i requested it. They havent got back to me yet. So will the scrub the debt and leave a default on my credit file or does it go to court? as ive said mate - not sure how it all works thanks for your help thus far
  21. guys not sure about how this all works - looks very technical quoting sections of law and what not i have debitas coming after me for a few hundred - the took on capital ones debt i setnt he template askin for the cca and the cheq for £1. they cashed the cheque a while ago - no cca - how sucessful have people been at askin for the CCA lay mans terms would be nice if poss

I asked the FO this moring for advice on where we go now - reply posted below with obvious details blanked Dear Mr xxxxx, Our initial understanding of the High Court judgment is that it answers some of the legal questions about bank charges - but not all of them. And either side in the legal action - the banks or the OFT - might decide to appeal aspects of today's judgment. So while we await further clarification, we will continue to keep complaints about unauthorised overdraft charges on hold.   25. the DCA is debitas mate - u obviously have had experience with this type of thing with capital one did you have any joy
