1062 post with your agreement - very interesting of course its quite readable and plus like the solicitor has said, the key info highlighted in yellow shows the terms, which of course mine in my mbna thread doe not show on the front but apparentely appear on the back - which i still am doubting

 

im going to see if i can actually get them to admit that what they have sent is accurate and in its original state or something,

 

this is now being sold and being passed to dca's so last swing saloon now plus mine dont say credit card agreement only credit agreeement

 

anyway keep positive and catch up later in the week,

Well has been said it's a good thing when an account gets sold outright: The DCA has probably paid 20p in the £1 for it and there is always the chance that the original is shredded during the transfer process. ;)

Been offline for most of the day due to the Bluetooth going down. Hardware not recognised. Had to delete a couple files and restart from cold. Did the trick.

Hard to use a computer when your wireless keyboard can't connect!

 

Anyway, had the strangest email this afternoon:

 

"Dear Davey,

 

Thank you for contacting Watchdog. We are not currently looking into this ourselves but would like to be able to pass your details onto the BBC You and Yours radio programme, who might be interested in talking to you further.

 

Please confirm by email whether you are happy for us to pass your details on?

It's strange because i emailed BBC Watchdog a year ago!! :eek:

 

Seems valid though. Links ok and reply email ending BBC so looks genuine. wow they really have a lot of emails to get through don't they!

What do watchdog mean by 'this'.... Debt stories? Are you kidding. What stories do they want in this current climate.. cats up trees and dodgy salesman?!

Hi Davey

 

Looks like your going to be famous going on TV and Radio.

Can we have your autograph when your famous lol, Oww forgot were not allowed to sign any documents lol.

Acknowledge to the Court the two claims for MBNA, but i think there on a sticky wickett. As the default notice the sent doesn't allow the set time for complying.

I replied back to Watchdog with a comment about how i emailed last june but thanking them and giving permission to pass on the details to which the reply was:

I'm always saying 'account in dispute therefore not entitled to demand payment etc' but it's struck me.. where exactly does this position come from? Is it in the CCA1974? I know there is certain reference to it in OFT Guidance but that's not very specific.

I know there is the OFT reference but i am sure there is something more out there apart from that:

 

Deceptive and/or unfair methods

2.7 Dealings with debtors are not to be deceitful and/or unfair.

 

2.8 Examples of unfair practices are as follows:

 

a. sending demands for payment to an individual when it is uncertain that

they are the debtor in question, for example, threatening debt recovery

action to 'the occupier' or sending a payment demand to all people sharing

the same name/date of birth as a debtor in the hope that contact with the

correct debtor will be made.

 

b. disclosing debt details to an individual when it is uncertain that they are

the debtor in question, for example, disclosing details to 'the occupier' of

an address.

 

c. refusing to deal with appointed or authorised third parties, such

as Citizens Advice Bureaux, independent advice centres or money

advisers

 

d. contacting debtors directly and bypassing their appointed representatives

 

e. operating a policy, without reason, of refusing to negotiate with debt management companies

 

f. passing on debtor details to debt management companies without the

debtors' informed prior consent

 

g. failing to refer on to the creditor reasonable offers to pay by instalments

 

h. not passing on payments received within a reasonable time resulting in

delays that adversely affect a debtor's financial position.

 

i. failing to investigate and/or provide details as appropriate, when a debt is queried or disputed, possibly resulting in debtors being wrongly pursued

 

j. requiring an individual to supply information to prove they are not the

debtor in question, for example, driving licences, passports, full name,

date of birth, signatures

 

k. not ceasing collection activity whilst investigating a reasonably queried or disputed debt.
