The Claimant has been a customer of the defendant bank since XXXDATEXXX account number XXXXXXXX.

 

The Claimant seeks :

A) an order under s.7(9) Data Protection Act 1998

 

B) The return of £XXXX taken from the claimant in unlawful charges.

 

 

A) The Defendant is notified as a Data Controller with the Data Protection Commissioner under registration no.XXXXXXX as responsible for the processing of data of which the Claimant is a data subject. On the XXXDATEXX and pursuant to s,7(1) and (2) of the Data Protection Act 1998 the Claimant served a written Subject Access Request notice on the Defendant at their notified address and which was accompanied by the statutory maximum fee of £10.

The Defendant has failed to comply with the Request.

The Claimant seeks an order that the defendant will comply with the Subject Access request within 7 days or such time-limit as is decided by the court.

Excellent.

 

Looking at the Barclaycard threads, would it be possible for someone to pay for their statements and them claim this back using the Data Protection Act?

 

Just to confirm does that have to be submitted at a court rather than through Moneyclaim because an order is being sought?

I did think on the same lines, as it goes. I don't know, is the answer. It makes sense, since it's obviously their fault that one didn't get the info, that one should be able to recover it from them.

not sure where to ask this question on a data protection act query but here goes.

 

a well known dvd hire chain insist on having a bank statement they say 'to comply with data protection act' in order to open an account, a driving licence and bank card is not enough apparently, no DD is being set up, I want to know why a simple letter with address on wont do?? hard to find utility bills in the name of not the homeowner isnt it.
