Hi everyone 

 

Received email from Lowell on 14 Th asking me to contact them for them to get an understanding of my circumstances re debt the debt relates to capital one and BT From 2016 the last payment on this was about November of 2016. I have been no fixed abode since then up until a couple of weeks ago

 

 

I couldn't give any address but they obviously had my email address for them to contact me now 

No payment or acknowledgement to anyone since then 

 

Unfortunately the email got deleted by mistake so I don't know what to do from here any help is much appreciated thank you

If what you say is correct then the debts will have become statute barred in November 2022 or even November 2021 if you live in Scotland.

 

See what others say but I would advise Lowell of your current address so they don't attempt to get a back door CCJ by sending a claim form to your old address.  Always best to advise creditors of your correct current whereabouts.

 

They will very likely send you a letter.   At that point, or even before that point, advise them it is statute barred.   There is a great template letter on this site I have used before.

 

Seems to me you are home clear.  They cannot enforce these debts and they probably have dropped off your credit reports (might be worth checking all three Credit Reference Agencies to make sure!).

easy killed by sending our statute barred letter.

 

dont forget a DCA is not a bailiff

and have zero legal powers

so ....

 

but you need to WRITE to them and tell them the debts are sB'd

that will also inform them of your address

 

2 birds well 3 killed with 2 sep letters in sep envelopes!

statute barred letter is in our debt collection section of our library

 

send two in 2 sep envelopes quoting each debts ref number

and also if you no it the original creditor and their org ref number.

 

send 2nd class

get free proof of posting from any PO counter for each.

 

do not sign the letter simply type you name

Go up on the fca register website and type in lowell see if rhere is a head office unless you know if its

Deleted email but managed to retrieve it , the address on that is a Po box will that one do

Also probably a silly question but do I respond to email too or just write to them sorry for all the questions but want to get it right

Ok send sep sb letters to the po box get free proof of posting

Lowell seem to have brought up a bunch of ancient Statute Barred debts recently. They do this because, their MO is to find people who have moved address , and gain a backdoor CCJ by default.  Their business model is very sound, buy a debt for pennies in the pound, send a few phishing letters and emails, if no response then a Claimform straight to the old address. Next thing the poor victim can't get a mortgage, because a CCJ has seemingly come from nowhere, and your credit is stuffed for the next 6 years.

 

Sadly I speak from bitter experience here, but now know that protecting yourself can be done for the price of a first class stamp.  Just send the Statute Barred letter.  Personally, I would also include another separate sheet with your current address.
