Looks to me like BWL have come up with another tactic.

They have a claim which is time expired for a response, and knowing that if they apply for judgment, they may not get paid by the defendant.

 

So, they leave it sitting there and offer the defendant the opportunity to pay "in instalments" in exchange for discontinuing the claim.

You say they emailed the response forms to defend...

long shot but, they haven't by any chance pre filled the claim number in to be helpful?

The regular tactic is to drag things out as much as possible, but as the date for acknowledgement has passed, I think the regular bland defence should be submitted to show good intent and reduce the chance of refusal by the court?

When you get this form directly from solicitors,  it's usually been sent early as an intimidating tactic.

Check status on MCOL.
