Hello All,

 

A workman parked on a section of pavement often used by others (delivery drivers etc) to perform a survey in my flat. On return, a PCN was issued for "Parking with one or more wheels on or over a footpath...".

 

The section of the pavement is a different colour from the main pavement and has drop curb access so vehicles can enter this section (see attached).

 

I have appealed to Hounslow, but they refused to cancel. Is this something i can fight?

the DYL rules cover the pavement to the property boundary too. a pavement is still part of the highway.

what has any colour of anything got to do with being allowed to park there?

it is still pavement parking.

 

you are not the sole building user, so going by that link i posted you have no exemption under that link.

fair enough.

 

To me, the curb drops on either end of the grey path to allow vehicles access (as it is used everyday by workmen).

Even the yellow raised blistered paving slab ends where it meets that section.

the ticket would state obstructing dropped kerbs if they were anything to do with the offence, it does not, it clearly says footpath.

 

you were all 4 wheels fully parked up on the pavement at 7:13PM, outside of normal working hours and normal users like delivery drivers by their nature are drop and run.

 

 a warden might have some sympathy with those badged traders and turn a blind eye, but at 7pm and for an unbadged van? and a good 1hrs or two, not a chance.

 

and being outside the parking restriction time for the DYL's is no excuse nor permission to fully park on a pavement at night or at anytime of day.

 

you will have a hard job arguing where you were parked is not a pavement .
