Is DPD or Van insurance company responsible for damage

Looking for a bit of help for my nephew.

 

Short story is a DPD van crash through his garden wall and into a car on his drive which was not insured

 

His home insurance has sorted the wall and he has been paid out but they will not help with the car, so he contacted dpd insurance company who have informed him because the driver claims the van suffered a blow out they are not responsible for the damage to his car and will not deal with the matter.

 

So would I be right in saying they are responsible ? if so and court action is needed would it be dpd or the insurance company that a claim is made against

DVD should be liable for everything. Including the wall and damage to the car.

In terms of the insurance payout for the wall, will he have incurred any penalties such as an excess or a higher insurance premium next year?

Get independent estimates of all of the damage – and quotes for repairs and then come back here.

Thanks not sure about extra excess or a higher insurance premium next year will ask, his home insurance paid out for the wall and said they would recoup it from dpd.

 

Had a garage come out and the cars a write off

They are right to be recovering it from DPD – but of course what is most likely to happen is that they will get all their money back from DPD – but at the same time they will jack up the insurance premium for next year because you have put in a claim. This means the insurance company will suffer no loss and your insurance will become more expensive.

You should pursue DPD and we will help you. You need to get a written confirmation that the vehicle is written off. Be aware that when you try to attack DPD, they will try to fob you off onto their insurer. Their insurer will be expert at knocking you down from what you consider is the appropriate write off value to something far less and they will also be expert at delaying you and causing you problems.

We will help you deal with this and we will make sure that you keep control of it and that you move it along at a pace that you decide not a pace decided by the insurer. Also we will make sure that the write off value is a proper value which allows you to get a complete replacement of the vehicle.

Why can't your nephew do this himself? It will be much easier if he came along and dealt with things directly rather than playing Chinese whispers.

Get at least one – preferably two independent assessments of the damage to the car. A detailed description of the damage would be helpful as well as photographs.
Get quotations for repair.

Have a very thorough research around the Internet and see if you can find the cost of equivalent cars in the same condition. About four or five valuations would be good. Take copies of the advertisements.

Then come back here and let us know what you have found and the value that you are looking at. We will then help you begin your claim against DPD and if necessary a court claim
